Description

    BACKGROUND OF THE INVENTION
  • 1. Field of the Invention
  • The present invention relates to headwear, and more particularly, to a headband which extends laterally from one side of the head to the other side of the head in order to keep the user's hair in place, the headband incorporating at its ends, pierced earrings cooperative with the pierced lobe of an ear.
  • 2. Description of the Prior Art
  • There are generally two types of headbands. The first headband which extends circumferentially about the head and positioned slightly above the eyebrows is commonly referred to as a sweatband. These types of headbands or sweatbands are worn to keep perspiration from entering and irritating the eyes. This type of headband or sweatband is most commonly worn while participating in athletics or physical exercise.
  • The second type of headband is a headband which extends laterally from one side of the head to the other side of the head. This head band is primarily utilized to maintain the user's hair in a styled position and out of the wearer's eyes. This type of headband is most often worn by women. Further, this type of headband can be produced from a variety of the materials. In order to maintain this type of headband in position, it normally requires incorporating a resilient biasing means so that the headband grips the sides of the individual's head.
  • Applicant has improved upon this type of headband by eliminating the requirement for a resilient biasing means and incorporating pierced earrings at the terminus of the headband, either separately or integral with the headband, the pierced earrings cooperative with a pierced lobe of an ear to position the earrings therein and to lock with the headband, therefore maintaining the headband in position.
  • Objects of the Invention
  • An object of the present invention is to provide for a novel headband which incorporates pierced earrings at the terminus thereof, the pierced earrings cooperative with the pierced lobe of an ear so as to lock with the headband and maintain it in position.
  • A still further object of the present invention is to provide for a novel headband with cooperative pierced earrings at the terminus, which eliminates the need for a resilient biasing means incorporated in the headband in order to grip the sides of the head.
  • A still further object of the present invention is to provide for a novel headband which can be fabricated from cloth, ribbon, metal, or any other decorative material without regard to resiliency and biasing.
  • SUMMARY OF THE INVENTION
  • A headband extending laterally from one side of the head to the other side of the head and designed to maintain a wearer's hair in position, the headband having secured at its two termini, a decorative pierced earring, the pierced earring cooperative with the pierced lobe of the ear, allowing the earring to be affixed through the ear and to the terminus of the headband, thus maintaining the headband in position on the user's head.

  • FIG. 1 is a perspective view of a headband and earring combination of the present invention, the head band fabricated from a cloth material;
  • FIG. 2 is a close-up view of a terminus of the headband of FIG. 1 illustrating the cooperativeness of the pierced earring and the headband;
  • FIG. 3 is a close-up side view of the headband and earring in position illustrating the securing of the pierced earring through the pierced lobe of the ear and through the headband;
  • FIG. 4 is a perspective view of the headband and earring combination of the present invention wherein the headband is fabricated from metal;
  • FIG. 5 is a perspective view of the headband and earring combination positioned on the head of an individual;
  • FIG. 6 is a perspective view of a headband which allow the termini of the headband to form an integral pierced loop earring; and
  • FIG. 7 is a perspective view of the headband wherein the termini form an integral dangling earring.
  • DETAILED DESCRIPTION OF THE INVENTION
  • FIG. 1 is a perspective exploded view of the headband assembly 10 of the present invention. The headband assembly 10 incorporates a headband 12 which can be configured to a U-shape to span the head of an individual from approximately ear to ear as more fully illustrated hereafter. Headband 12 illustrated in FIG. 1 is constructed of a fabric material which is placed laterally over the head of the individual in order to maintain the wearer's hair in position. In the illustration in FIG. 1, headband 12 is constructed of cloth and is dimensioned to fit over the head and hair of a particular individual. The headband 12 has a width 14 and a length 16, the dimensions allowing for the maintenance of a particular thickness and style of hair in a particular manner. The headband 12 has two terminus 18 and 20. When positioned, the terminus are positioned proximate the rear of the lobe of the ear.
  • The second element of the headband assembly 10 is a pierced earring 26. The pierced earring may be separate from the headband or integral therewith as hereinafter detailed. The separate pierced earring 26 comprises a decorative base 28 which may be a stud or a hanging earring, the face has a rearwardly facing post 30 designed to pass through a pierced earlobe. In normal procedures, the post would have a locking member 32 secured to its end 34 after being positioned through the pierced lobe of the ear. In the instant invention, the post 30 of the pierced earring 26 is in communication with and passes through the terminus portion 18 and 20 of headband 14 before locking member 32 is engaged with post 30.
  • In the manner illustrated in FIG. 1, the pierced earring maintains the position of the headband 12 on the head of the individual. There is no requirement that the headband 14 be fabricated from or have incorporated therein a resilient biasing means needed to maintain the headband in position on the head.
  • FIG. 2 is a close up view of one terminus 20 of headband illustrating a close up view of the cooperativeness of the pierced earring 26, post 30, and locking member 32 with respect to the headband.
  • FIG. 3 is a close up view of headband 12 and earring 26 in position illustrating the securing of the pierced earring through the pierced lobe 36 of the ear and through headband 12. In both FIGS. 2 and 3, the headband 12 is illustrated as being fabricated from a cloth, fabric, or ribbon-like material. The width of the headband 14 can vary depending upon the choice of the individual. The length of the headband 12 will be dictated by the size of the individual's head and the thickness and style of hair which the individual wearer wishes to maintain and place. The headband 12 can also be fabricated from a material having a thickness greater than a piece of cloth, such as a woven fabric or braided or rope-like fabric, metal, plastic, or link material without departing from the spirit and scope of the invention.
  • FIG. 4 is a perspective view of headband 12 and the earring 26 combination of the present invention wherein the headband 12 is fabricated from a series of interconnected decorative metal or foil elements 40. The function of the headband 14 as illustrated in FIG. 4 is identical to the function of the headbands illustrated in FIGS. 1 through 3. The metal or foil elements 40 are either interlocked so that they articulate with respect to each other, or they are interconnected by way of flexible linear connectors 42, such as decorative cord or the like, which allows the metal or foil elements 40 to conform to the shape of the head and the thickness and style of the hair which is to be maintained by the headband. The cooperativeness of the metal or foil elements 40 on headband 12 with earring 26 and pierced earlobe 36 are identical.
  • FIG. 5 is a perspective view of the headband and earring combination positioned on the head of an individual. The dimensions of the headband 12 are such that it fits snugly laterally on the head of the individual maintaining the individual's hair in position without placing undue pressure or tension on the head of the individual, the pierced earring cooperating with the headband to maintain it in position without the need for a resilient biasing means which would put pressure onto the head of the individual, and particularly in the area proximate to and rearwardly of the temples.
  • FIG. 6 is a perspective view of a headband which allows the termini of the headband to form an integral pierced earring. As illustrated in FIG. 6, the headband 12 extends over the head and has excess material which extends below the earlobe 36 of the ear. Mounted proximate the terminus 18 and 20 of the headband 12 is a post 30 integral with the headband and designed to pass through the pierced earlobe 36. In so doing, the termini of the headband form a loop earring 50. The post is secured through the portion of the headband 12 which remains positioned rearwardly of the pierced lobe 36 and the locking member 32 or a decorated stud would be positioned in the front of the earlobe. In this fashion, the headband 12 forms an integral loop earring. It will be recognized by those of ordinary skill in the art that similarly, rather than form a loop, the rearward facing post 30 could be fashioned onto the headband 12 and extend from the rearward portion of the pierced earlobe 36 forwardly, and having a securing means at the front of the earlobe, thus providing for a dangly depending earring integral with the headband 12 (See FIG. 7). In this embodiment, the headband material can again be of any desired material such as cloth, fabric, woven, chain link, plastic link, or metal link.
  • Therefore, while the present invention has been disclosed with respect to the preferred embodiments thereof, it will be recognized by those of ordinary skill in the art that various changes and modifications can be made without departing from the spirit and scope of the invention. It is therefore manifestly intended that the invention be limited only by the claims and the equivalence thereof.

Claims (5)

I claim:
1. Headwear to keep hair contained and which incorporates a pierced earring to maintain the headwear in position on the head, the headwear comprising:
a headband extending from one lateral side of the head to the opposing lateral side of said head across the top of said head, terminating proximate the lobe of the ear on the respective lateral sides of said head;
a pierced earring having a post for penetrating the pierced ear, said post further penetrating said headband, proximate its respective termini, said post locked in position with a locking member with said pierced earring maintaining said headband in position on said head and consequently maintaining the wearer's hair in position.
2. The headwear in accordance with claim 1 wherein said pierced earring and said post and said locking member are independent of said headband and are secured to said headband proximate said respective termini of said headband.
3. The headwear in accordance with claim 1 wherein said headband extends beyond the lobe of the ear on each lateral side of said head, said headband having affixed thereto a post for positioning through said pierced earlobe from the rear and forming a loop with said termini of said headband, and a locking member, said loop hanging downwardly from said lobe of said ear.
4. The headwear in accordance with claim 1 wherein said headband is formed from cloth, fabric, metal, plastic, or chain link.
5. The headwear in accordance with claim 1 wherein said headband is cooperative with a post formed on said headband, said post extending from the rear of the earlobe through said pierced earlobe and terminating with a decorative earring on the front of the earlobe, together with an extended dangling portion of said headband.
