Application filed October 20, 1916. Serial No. 126,748.
To all whom it may concern:
Be it known that I, OSCAR DE LONG, a citizen of the United States, residing at Conesville, in the county of Coshocton and State of Ohio, have invented new and useful Improvements in Railroad-Tie Holders, of which the following is a specification.
This invention relates to an improvement in means for holding a rail upon a tie to facilitate the spiking of the rail to the tie.
In carrying out my invention it is my purpose to produce a tie holding implement comprising a substantially arched member having tie engaging hooks pivotally secured to the ends thereof and having hingedly secured thereto a lever that has its inner end provided with an enlargement or head that is adapted to rest upon the head of a rail that is arranged upon the tie, while the opposite end of the lever is weighted, whereby the lever will be automatically swung to force the rail upon the tie, the weighted end of the lever being sufficient to retain the tie and rail in such engaging position to permit of the insertion of the spikes for retaining the rail upon the tie.
It is a further object of the invention to produce a tie holding device which shall embody the desirable features of simplicity, cheapness, ease of application and efficiency in operation.
With the foregoing objects in view and others as will appear as the description of the invention is proceeded with, the invention resides in the construction, combination and arrangement of parts set forth in the following specification and falling within the scope of the appended claim.

- In practice two tie holders constructed in accordance with my invention are employed upon each rail, one being arranged adjacent to the endsof the said rail.
In the drawing the numeral 1 designates a rail, and 2 the ties to which the rail is to be spiked.
As shown by the drawings, the holder comprises a substantially yoke-shaped frame 3 which has pivotally secured, as at 4, to the ends thereof the offset ends of hook members 5. These hooks are adapted to be disposed to the opposite sides of the tie and the offset ends thereof are adapted to underlie and engage with the tie. The body or frame 3 is flat and is disposed to the outer side of the tie, resting against the said tie, but of course, if desired, the device may be arranged upon the inner sides of the tie. To the upper end of the frame 3 is hingedly secured, as at 6, a substantially rectangular lever 7, and the outer end of this lever is provided with a weight 8. The lever 8, adjacent to its hinged connection with the frame 3, upon one of the edges thereof is provided with an offset flat enlargement or head 9, and this head rests upon the ball or head of the rail 1. The lever is of a length less than the distance between two of the rails of a railway and the weight 8 thereof is sufiicient to at all times retain the rail in engaging position with the tie.
In the application of the device, it will be apparent that the tie 2, when the improvement is arranged as above described, will through the medium of the weighted lever 7 be moved into contacting position with the rail 1, and the weight of the lever is also suflicient to retain the tie and rail in such contacting relation to permit of the insertion of the spikes whereby the rail is secured to the tie.
From the above description, taken in connection with the accompanying drawings, the simplicity of the device, as well as the advantages thereof will, it is thought, be perfectly apparent to those skilled in the art to which such invention appertains without further detailed description.
Having thus described the invention, what is claimed is:
