【発明の属する技術分野】
本発明は、ソフトウェア提供システム、制限解除情報提供システム、ソフトウェア提供方法、ソフトウェア提供プログラムを記録した媒体、制限解除情報提供方法および制限解除情報提供プログラムを記録した媒体に関する。

【従来の技術】
近年のコンピュータの急速な普及に伴って、ハードディスクドライブやＭＯドライブなど、周辺機器の需要が増大している。これらの周辺機器の性能は日々進歩しており、各周辺機器間の性能差は利用者が製品を選択する重要な指標になるものの、上述のようにコンピュータが普及するにつれ利用者のニーズが多様化し、性能差のみならずコストパフォーマンスや付加価値等の製品購入時のサービス差がより重要な製品選択の指標となっている。このような付加価値として、例えば、ハードディスクドライブにフォーマッタ等のユーティリティソフトウェアを添付することがあり、ハードディスクドライブ製品パッケージにＣＤ−ＲＯＭを同梱し、同ＣＤ−ＲＯＭに複数のユーティリティソフトウェアを記録している。

【発明が解決しようとする課題】
上述した従来のソフトウェア提供においては、次のような課題があった。
すなわち、上記ハードディスクドライブ等の周辺機器とユーティリティソフトウェアとの提供者が異なる場合等には周辺機器の提供者はユーティリティソフトウェアの提供者に対しライセンス料を支払っている。従って、サービス向上のためユーティリティソフトウェアの添付数を増加させるほど、周辺機器の提供者が支払うライセンス料が多額になり、ひいては周辺機器の販売価格を上昇させてしまう。
本発明は、上記課題にかんがみてなされたもので、ソフトウェアの提供に伴って製品提供者が支払うライセンス料を低減し、製品のコストパフォーマンスを向上させることが可能なソフトウェア提供システム、制限解除情報提供システム、ソフトウェア提供方法、ソフトウェア提供プログラムを記録した媒体、制限解除情報提供方法および制限解除情報提供プログラムを記録した媒体の提供を目的とする。

【課題を解決するための手段】
上記目的を達成するため、請求項１にかかる発明は、ソフトウェアが同梱された製品の購入者に対して当該ソフトウェアを提供するソフトウェア提供システムであって、上記ソフトウェアに対して予め付与された価値点数を蓄積するソフトウェア価値点数蓄積手段と、購入者の有する価値点数を蓄積する購入者価値点数蓄積手段と、適正な購入者であるか否かを認証するための認証情報を蓄積する購入者認証情報蓄積手段と、上記購入者からのソフトウェア提供要求を受け付けるソフトウェア提供要求受付手段と、上記購入者認証情報蓄積手段に蓄積された認証情報に基づいて、上記ソフトウェア提供要求受付手段によるソフトウェア提供要求が上記購入者によってなされたか否かの認証を行う購入者認証手段と、上記購入者認証手段によってソフトウェア提供要求に対して認証がなされたときに上記購入者価値点数蓄積手段に蓄積された購入者の価値点数を減じるとともに更新させ、当該提供要求にかかるソフトウェアを上記購入者に提供するソフトウェア提供手段とを具備する構成としてある。

上記のように構成した請求項１にかかる発明においては、ソフトウェアが同梱された製品の購入者に対して当該ソフトウェアを提供するにあたり、提供可能にされた複数のソフトウェアのうち、限られた購入者価値点数の範囲内で購入者が所望のソフトウェアを選択できるようになっている。このため、ソフトウェア価値点数蓄積手段には上記ソフトウェアに対して予め付与された価値点数が蓄積され、購入者価値点数蓄積手段には購入者の有する価値点数が蓄積され、購入者認証情報蓄積手段には適正な購入者であるか否かを認証するための認証情報が蓄積されている。

ソフトウェア提供要求受付手段においては、上記購入者からのソフトウェア提供要求を受け付け、購入者認証手段においては、上記購入者認証情報蓄積手段に蓄積された認証情報に基づいて、上記ソフトウェア提供要求受付手段によるソフトウェア提供要求が上記購入者によってなされたか否かの認証を行うようになっている。そして、ソフトウェア提供手段は、上記購入者認証手段によってソフトウェア提供要求に対して認証がなされたときに上記購入者価値点数蓄積手段に蓄積された購入者の価値点数を減じるとともに更新させ、当該提供要求にかかるソフトウェアを上記購入者に提供する。

すなわち、購入者には予め購入者価値点数が付与されており、ソフトウェアのそれぞれに対してもソフトウェア価値点数が蓄積されており、ソフトウェア価値点数の合計が自己の購入者価値点数の範囲内に収まるのであれば、購入者は任意にソフトウェアを選択して提供を受けることができる。従って、製品の提供者は多くのソフトウェアを提供可能にしつつも、上記購入者価値点数に対応した限られた範囲内でのライセンス料、あるいは実際にソフトウェアを提供したもののみに対してのライセンス料を支払えばよく、提供者に課されるライセンス料が低減される。また、提供者に課されるコストが低減されるということは製品販売価格の低下に直結し、利用者に対してコストパフォーマンスの高い製品を提供できる。

ここで、本発明はソフトウェアが製品に同梱している場合に適用することが可能であり、上述のようなコンピュータの周辺機器の他、コンピュータ本体にソフトウェアが同梱されている場合にも適用することができる。さらに、所定のアプリケーションプログラムに対するプラグインやアップグレードモジュールを提供する場合など、ソフトウェア製品にソフトウェアが同梱されている場合にも適用することができる。さらに、雑誌の付録として種々のソフトウェアが記録されたＣＤ−ＲＯＭを提供する場合等にも適用可能である。上記購入者認証手段においては、上記購入者認証情報蓄積手段に蓄積された認証情報に基づいて、上記ソフトウェア提供要求が上記購入者によってなされたか否かを認証できれば良く、種々の態様が採用可能である。

例えば、予め各製品毎に製品ＩＤと購入者認証ＩＤとを付与して上記購入者認証情報蓄積手段に当該製品ＩＤと購入者認証ＩＤとの対応関係を蓄積する。そして、上記ソフトウェア提供要求を受け付ける際に同時に当該製品ＩＤと購入者認証ＩＤとを受け付け、上記蓄積した製品ＩＤと購入者認証ＩＤと比較すれば、適正な購入者である旨を認証することができる。この場合は、製品ＩＤと購入者認証ＩＤとが上記認証情報である。むろんかかる構成は一例であり、例えば、ＷＥＢやはがきによってユーザー登録を行わせ、登録時にユーザー指定のパスワードを記載してもらって、所定のＷＥＢサーバに登録することによってかかるパスワードを認証に使用することなども可能である。さらに、各製品毎に製品ＩＤを付与し、各ソフトウェアにソフトウェアＩＤを付与して蓄積し、認証ＩＤとソフトウェアＩＤとを同時に受け付けることによって、購入者の認証とソフトウェアの選択要求とを同時に行うように構成することなども可能である。

また、上記ソフトウェア価値点数蓄積手段と、購入者認証情報蓄積手段と、購入者価値点数蓄積手段とにおいては所定の情報を読み出し、書き込むことができれば良く、ハードディスクドライブや磁気光ディスク，ＲＡＭ等種々の記憶装置を採用することができる。購入者価値点数は、提供を受けるソフトウェア価値点数の合計の上限を示しており、提供者のライセンス料支払い能力や製品価格，ソフトウェアに対するライセンス料の要否等によって適宜変更可能である。さらに、ソフトウェア価値点数は種々の指標に基づいて決定することが可能であり、その一例として請求項２にかかる発明は、上記請求項１に記載のソフトウェア提供システムにおいて、上記ソフトウェア価値点数蓄積手段において蓄積するソフトウェア価値点数は、上記提供するソフトウェアの価格に応じて付与される構成としてある。

上記のように構成した請求項２にかかる発明においては、ソフトウェアの価格に応じて付与されたソフトウェア価値点数がソフトウェア価値点数蓄積手段において蓄積されている。すなわち、製品の提供者が支払うライセンス料は通常ソフトウェアの価格に依存するので、ソフトウェア価値点数がソフトウェアの価格に連動していなければ、同じ購入者価値点数でも発生するライセンス料が異なってくることも想定され、ライセンス料の計算が複雑になってしまう。しかし、ソフトウェア価格とソフトウェア価値点数とがある程度連動していれば、購入者価値点数によって一律にライセンス料を決定することができて好適である。一方、購入者がソフトウェアの選択をするに当たり、ソフトウェアの価格とソフトウェア価値点数とが連動していれば、購入者は提供を受けるソフトウェアに対する価値判断を明確に行うことができ、提供ソフトウェアを決定し易くなる。

さらに、ソフトウェア価値点数を決定する他の指標の一例として請求項３にかかる発明は、上記請求項１または請求項２のいずれかに記載のソフトウェア提供システムにおいて、上記ソフトウェア価値点数蓄積手段において蓄積するソフトウェア価値点数は、上記提供するソフトウェアの機能制限の度合に応じて付与される構成としてある。上記のように構成した請求項３にかかる発明においては、提供するソフトウェアの機能制限の度合に応じて付与されたソフトウェア価値点数がソフトウェア価値点数蓄積手段において蓄積される。

すなわち、ソフトウェアの提供に当たっては、とりあえず体験版を提供し、あるいは使用日数制限をするなどして、機能制限のある状態で提供しておき、認証がなされた後にこの機能制限を解除することなどが考えられる。この場合、購入者はソフトウェアを試用した後に、実際の提供を受けるか否かを決定することが可能になり、より多様なサービスを提供することができる。また、ソフトウェアの提供者は体験版や機能制限のある状態でソフトウェアを提供するのであればライセンス料を要求しない場合などが考えられる。このような場合は機能制限の解除とともにライセンス料が発生するので、当該機能制限の解除に応じてソフトウェア価値点数を計算するのが好適である。さらに、機能制限は種々の態様で行うことが可能であって、機能制限の度合に応じてソフトウェア価値点数を付与すると購入者が自己の必要に応じて選択できる範囲が広がり、より多様なサービスを提供することが可能になる。

さらに、本発明を実現するに当たって、利用者に対して価値点数等を示すのに好適な態様の一例として請求項４にかかる発明は、上記請求項１〜請求項３のいずれかに記載のソフトウェア提供システムにおいて、上記購入者には、上記ソフトウェアに対して付与された価値点数と上記製品の購入時における上記購入者価値点数と上記購入者の認証に必要な認証情報との一覧表が提供される構成としてある。上記のように構成した請求項４にかかる発明においては、製品の提供に当たり、一覧表が提供される。すなわち、購入者は上記価値点数等を知ることができなければ本発明による利益を享受することができないので、かかる一覧表に価値点数等を記載することによって必要な情報を容易に提供することができる。

さらに、利用者に対して価値点数等を表すのに好適な他の構成例として請求項５にかかる発明は、上記請求項１〜請求項４のいずれかに記載のソフトウェア提供システムにおいて、上記購入者には、上記ソフトウェアに対して付与された価値点数を示すデータと上記製品の購入時における上記購入者価値点数を示すデータと上記購入者の認証に必要な認証情報を示すデータとが記録されたコンピュータ読みとり可能な記録媒体が提供される構成としてある。

上記のように構成した請求項５にかかる発明においては、購入者にコンピュータ読みとり可能な記録媒体が提供され、当該媒体に上記ソフトウェアに対して付与された価値点数を示すデータと上記製品の購入時における上記購入者価値点数を示すデータと上記購入者の認証に必要な認証情報を示すデータとが記録されている。すなわち、上記価値点数データ等は上記記録媒体を介してコンピュータに読みとられるので、当該データを読みとったコンピュータによって所定のプログラムを実行させることによって、上記ソフトウェア提供要求や認証等を自動化したり、対話形式で実行可能に構成すること等が可能である。

また、上記所定のプログラムを当該記録媒体に記録させておくと好適であり、さらに、コンピュータの読みとり装置に記録媒体を装填した段階で自動実行されるように構成すると購入者が行う作業が低減され、より好適である。むろん、記録媒体は種々のものが採用可能であって、普及率の高いＦＤやＣＤ−ＲＯＭ等を採用すると好適であるが、他の磁気記録媒体であってもよいし光磁気記録媒体であってもよいし、今後開発されるいかなる記録媒体においても全く同様に考えることができる。

さらに、上記ソフトウェア提供要求受付手段においては、購入者からのソフトウェア提供要求を受け付けることができればよく、かかる構成の一例として請求項６にかかる発明は、上記請求項１〜請求項５のいずれかに記載のソフトウェア提供システムにおいて、上記ソフトウェア提供要求受付手段は、ネットワーク回線を介して上記購入者からのソフトウェア提供要求を受け付ける構成としてある。

上記のように構成した請求項６にかかる発明において、ソフトウェア提供要求受付手段は、ネットワーク回線を介して上記購入者からのソフトウェア提供要求を受け付ける。すなわち、本発明にかかるソフトウェア提供システムと購入者がソフトウェア提供要求を行うコンピュータとは離れた場所にあり、購入者は自己の有するコンピュータを介して当該ソフトウェア提供システムにアクセスすることができる。例えば、ＷＥＢサーバの一機能として本発明にかかるソフトウェア提供システムを構成し、購入者がインターネットを介して当該ＷＥＢサーバにアクセスするように構成すれば購入者はいつでも自宅で本発明にかかるサービスの提供を受けることができて好適である。

さらに、請求項７にかかる発明は、上記請求項１〜請求項６のいずれかに記載のソフトウェア提供システムにおいて、上記ソフトウェア提供手段は、ネットワーク回線を介して上記提供要求にかかるソフトウェアを上記購入者に提供する構成としてある。上記のように構成した請求項７にかかる発明においては、ソフトウェア提供手段は、ネットワーク回線を介して上記提供要求にかかるソフトウェアを上記購入者に提供する。すなわち、本発明にかかるソフトウェア提供システムと購入者がソフトウェア提供要求を行うコンピュータとは離れた場所にあり、購入者は自己の有するコンピュータを介して当該ソフトウェア提供システムにアクセスすることができる状況において、ソフトウェアをダウンロードすることができる。

この場合、製品にソフトウェアの本体を添付する必要がないので、提供可能なソフトウェアの数が非常に多くなったとしても、製品に大容量記憶媒体を添付する必要が無く好適である。また、製品販売当初に存在しなかったソフトウェアを追加して提供可能にすることもできる。この場合も上述のように、ＷＥＢサーバの一機能として本発明にかかるソフトウェア提供システムを構成し、購入者がインターネットを介して当該ＷＥＢサーバにアクセスするように構成すれば購入者はいつでも自宅で本発明にかかるサービスの提供を受けることができて好適である。

さらに、請求項８にかかる発明は、上記請求項１〜請求項７のいずれかに記載のソフトウェア提供システムにおいて、上記ソフトウェア提供手段は、ソフトウェアを適切に実行可能にするためのパスワードを提供する構成としてある。上記のように構成した請求項８にかかる発明においては、ソフトウェアを適切に実行可能にするためのパスワードを提供することで、ソフトウェアの提供を行っていると言える。

すなわち、製品に対してＣＤ−ＲＯＭを添付し、当該ＣＤ−ＲＯＭに記録されたソフトウェアの提供を受ける場合に、ソフトウェアのインストールにパスワードが必要とされるように構成すれば、当該ＣＤ−ＲＯＭを製品に添付しても、パスワードを提供してはじめてソフトウェアを提供したと言える。本構成は、上述のようにソフトウェアをダウンロードする構成に適用することもできるが、上述のようにＣＤ−ＲＯＭにソフトウェアを記録して提供し、パスワードをネットワーク回線を介して提供されるようにすれば、通信料金が低減できて好適である。

上述の発明は、製品に添付されるソフトウェアを利用可能に提供するものであり、ソフトウェアに対して利用制限がかけられており、上記購入者価値点数の範囲内で当該利用制限が解除できるものであると言える。この意味においては、本発明は、製品添付ソフトウェアを利用可能にするもののみならず他の種々の製品の利用制限解除に適用することができる。
かかる構成の一例として、請求項９にかかる発明は、利用制限が課された製品の利用制限を解除するための制限解除情報を提供する制限解除情報提供システムであって、利用者の有する利用者価値点数と上記利用制限が課された製品に対して予め付与された製品価値点数と利用者を識別するための情報とを蓄積する情報蓄積手段と、利用者が利用制限解除を要求した製品を示す情報と利用者を認証するための情報とを取得する解除要求情報取得手段と、上記解除要求情報取得手段によって取得された利用者を認証する情報と上記情報蓄積手段に蓄積された利用者を識別するための情報とに基づいて利用制限解除を要求した利用者の認証を行う利用者認証手段と、上記情報蓄積手段を参照し、上記取得した解除要求製品情報に基づいて解除要求にかかる製品の製品価値点数が上記利用者価値点数以内であるか否かを判別する価値点数判別手段と、同価値点数判別手段によって上記製品価値点数が上記利用者価値点数以内であると判別されたときに、利用者に対して当該製品の利用制限を解除するための制限解除情報を提供する制限解除情報提供手段とを具備する構成としてある。

上記のように構成した請求項９にかかる発明においては、製品に対して利用制限が付与されており、制限解除情報の提供を受けることによって利用制限を解除することができる。すなわち、ソフトウェアのみならず、ハードウェア等に利用制限がある場合に本発明を適用することができる。また、製品購入当初には上記価値点数は添付ソフトウェアを提供するためのものとしつつも、利用者の新たな料金納付に応じて利用者価値点数を増加させるなどして、製品に添付されたソフトウェア以外の一般のソフトウェアを提供する場合に本発明を適用することも可能である。ここで、上記制限解除情報は所定のパスワードやＩＤ番号等を提供するように構成しても良いし、ネットワーク回線を介して接続されたハードウェアを、当該ネットワーク回線を介して直接制御して利用制限を解除するように構成することなどもできる。

また、このようなソフトウェア提供システムおよび制限解除情報提供システムにおいては所定のプログラムが実行され、同プログラムは上述の手段に対応した所定の制御手順に従って処理を進めていく上で、その根底にはその手順に発明が存在するということは当然である。従って、本発明は方法としても適用可能であり、請求項１０または請求項１２にかかる発明においても、基本的には同様の作用となる。すなわち、必ずしも実体のあるシステムに限らず、その方法としても有効である。

さらに、上述のようにソフトウェア提供システムおよび制限解除情報提供システムにおいては上記所定のプログラムが実行されるので、これらのプログラムが記録された媒体として発明を捉えることもできる。従って、請求項１１または請求項１３にかかる発明においても、基本的には同様の作用となる。ここで、コンピュータ読み取り可能な記録媒体は、磁気記録媒体であってもよいし光磁気記録媒体であってもよいし、今後開発されるいかなる記録媒体においても全く同様に考えることができる。また、一次複製品、二次複製品などの複製段階については全く問う余地無く同等である。さらに、上記媒体とは異なるが、供給方法として通信回線を利用して行なう場合であれば通信回線が伝送媒体となって本発明が利用されることになる。

【発明の効果】
以上説明したように本発明によれば、自己の購入者価値点数の範囲内で購入者が任意にソフトウェアを選択して提供を受けることができる。従って、製品の提供者は多くのソフトウェアを提供可能にしつつも、限られた範囲内でのライセンス料を支払えばよく、提供者に課されるライセンス料が低減される。この結果、製品販売価格が低下し、利用者に対してコストパフォーマンスの高い製品を提供しつつソフトウェアを提供することが可能なソフトウェア提供システムを提供することができる。
また、請求項２にかかる発明によれば、製品提供者のライセンス料を明確に決定することができ、また、製品購入者がソフトウェアを選択しやすくなる。
さらに、請求項３にかかる発明によれば、多様な形態でソフトウェアを提供することができる。

さらに、請求項４にかかる発明によれば、製品購入者が必要な情報を容易に提供することができる。
さらに、請求項５にかかる発明によれば、ソフトウェア提供要求や認証等を自動化したり、対話形式で実行するように構成可能であり、多様なサービスを提供することができる。
さらに、請求項６にかかる発明によれば、購入者はいつでも容易に本発明にかかるサービスの提供を受けることができる。
さらに、請求項７にかかる発明によれば、提供可能なソフトウェアの数が非常に多くなったとしても、製品に大容量記憶媒体を添付する必要がない。また、製品販売当初に存在しなかったソフトウェアを追加して提供可能にすることもできる。
さらに、請求項８にかかる発明によれば、ネットワーク回線を使用する場合に通信料金が低減できる。
さらに、請求項９にかかる発明によれば、種々の対象に対して適用することが可能な制限解除情報提供システムを提供することができる。

【発明の実施の形態】
以下、図面にもとづいて本発明の実施形態を説明する。
図１は、本発明の一実施形態にかかるソフトウェア提供システムを使用してソフトウェアを提供するように構成されたハードディスクドライブパッケージ製品を示している。同図において、当該ハードディスクドライブパッケージ製品は製品本体であるハードディスクドライブ（ＨＤＤ）１０とシリアルＩＤや購入者ポイント等が記載されたポイント表示カード１１と複数のソフトウェアのプログラムが記録されたＣＤ−ＲＯＭ１２とから構成されている。すなわち、ハードディスクドライブパッケージ製品にはポイント表示カード１１とＣＤ−ＲＯＭ１２とが同梱されており、購入者が同ＣＤ−ＲＯＭ１２に記録されたプログラムを汎用コンピュータにインストールすることによってハードディスクドライブ１０に同梱されたソフトウェアの提供を受けるようになっている。

また、本実施形態においては、上記ＣＤ−ＲＯＭ１２に記録されているソフトウェアは体験版として何ら制限なくインストールすることが可能になっている。
ここで、各ソフトウェアに対してはソフトウェアポイントが付与され、購入者に対しては購入者ポイントが付与されており、ハードディスクドライブパッケージ製品の購入者は上記ソフトウェアポイントの合計が自己の購入者ポイントの範囲内であれば任意に選択してソフトウェアのパスワードの提供を受けることができる。購入者は当該パスワードを使用して上記インストールした体験版ソフトウェアを完全版に変更するように使用制限を解除することが可能であって、このようなパスワードの提供によってソフトウェアの提供を受けているといえる。本実施形態においては上記ソフトウェア価値点数がソフトウェアポイントに該当し、上記購入者価値点数が購入者ポイントに該当する。

上述のようにこれらのポイントは上記ポイント表示カード１１に記載された状態で購入者に提供され、本実施形態において同ポイント表示カード１１は図２に示すようなレイアウトで各ポイントを表示している。同図において、同ポイント表示カード１１の左上部には上記購入者ポイントが記載されており、初期には購入者に対して「１０」ポイント付与されている。同購入者ポイントの下部にはシリアルＩＤが記載されている。また、ポイント表示カード１１の中央には上記ＣＤ−ＲＯＭ１２に記録されたソフトウェア名とソフトウェアＩＤとが対応させられつつ列記されている。本実施形態において上記シリアルＩＤは、ハードディスクドライブ１０に対して一義的に与えられたＩＤであり、ソフトウェアＩＤは各ソフトウェアに対して一義的に与えられたＩＤである。これらのシリアルＩＤとソフトウェアＩＤとは後述するように適正な購入者であるか否かを認証するために使用され、上記認証情報に該当する。

本実施形態において、製品の提供者はインターネットに接続されたサーバに所定の機能を実行させることによって同サーバをソフトウェア提供システムとして構成しており、上述のようなハードディスクドライブパッケージ製品の購入者が本発明にかかるソフトウェア提供システムを利用可能にしている。図３は、上記製品の提供者が構成するサーバと購入者が使用するクライアントによって構成されるネットワークの概略を示しており、本発明にかかるソフトウェア提供システムの一利用態様を示している。同図において、サーバ２０はインターネット専用回線を介してインターネット網１５に接続されており、購入者は自己が有する汎用コンピュータを使用して公衆回線を介してインターネット網１５に接続可能であって、この場合に購入者が使用する汎用コンピュータは本ソフトウェア提供システムにおいて上記サーバ２０に対するクライアント３０となる。

以下、上記構成および処理フローにおけるパスワード提供動作の一例を説明する。本説明においては、ハードディスクドライブパッケージ製品の購入者がクライアント３０に対してＣＤ−ＲＯＭ１２に記録されたソフトウェアの体験版をインストールして試用した結果、同購入者が「Ｃｏｐｙ」と「Ｐａｒｔｉｔｉｏｎ１」との提供を受けようとする場合について説明する。購入者は、ブラウザ３４を利用していつでも自己の購入者ポイントを照会することが可能になっており、照会のためには上記ポイント表示カード１１を参照して、自己のシリアルＩＤ「ＨＤ０００１１０」を上記シリアルＩＤ入力ボックス３４ｂに入力した状態で上記照会ボタン３４ｃをクリックする。
