Description
A METHOD OF ANALYSIS OF INFORMATION CONTENT ON A DATA COMMUNICATION INFRASTRUCTURE
FIELD OF THE INVENTION
The present invention concern the field of electronic information data management, and in particular relates to a method of analysis of information content on a data communication infrastructure.
The present invention further concerns a system for managing information content related to a natural or legal person in a data communication infrastructure.
The present invention further concerns a software program, particularly adapted to perform and/or allow to perform said electronic information data management.
All those three parts of the invention are specifically conceived for the purpose of allowing a specific subject of interest transmit comments data concerning credit worthiness or banking details.
BACKGROUND OF THE INVENTION
Guidelines, rules, regulations and orders governing topics such as libel via press and/or via the Internet, right of reply and right to oblivion are nowadays known.
Regulation (EU) 2016/679 of the European Parliament and Council, dated 27 April 2016, on the protection of individuals with regard to the processing of personal data and on the free circulation of such data, which abrogated the previous Directive 95/46/EC dated 24 October 1995, is known.
In addition to the above, European Regulation approved in 2016 regarding data treatment, which substantially has replaced the Directive 95/46/EC, is known.
-1All of the above directives, regulations and orders regulate the aspects of the processing of personal data of individuals and use that search engines can make of the above information content.
It is hereby recalled the vital role that search engines have over the information content and their visibility and relevance of data communications networks.
The Applicant anyway believes that those rules, more or less specific, have not solved the problem of the presence of little or not at all true and/or unreliable and sometimes even defamatory contents.
The Applicant also believes that the failure in solving that problem is due at least to the following reasons:
- there are times and costs for the defense of his own reputation, if proven as injured, and not all users affected by the problem of the defamatory content have the time and/or the economic means to defend themselves in the appropriate forums, virtual or real (courts or arbitration);
- the right of reply, and the reply by the user affected by the defamatory content is possible only in a time that is subsequent than that of the publication and reading of the defamatory or more or less true information content;
- the right of reply, and its user replication affected by defamatory, never the same evidence and ranking than in defamatory or more or less truthful same;
- the negative news, and among these the defamatory contents, are the most widely read and indexed by search engines among the other news or information content (positive or neutral that they are for the user therein directly mentioned and therefore affected), and consequently they are those that are the most widespread in the web.
In view of the above, the Applicant deems that nowadays an effective and simple means to replicate to offensive and/or defamatory, or otherwise unwanted content on data communications network in general and in particular in the web is lacking and that such reply, whenever possible, has never the same contemporaneity and relevance to the attack suffered reputational. Please remember that the above problem is often the subject of lawsuits, with the relative and consequent expenses and reputational issues, which sometimes involve the major search engines or indexers too, such as Google® itself.
-2In addition to the above, the Applicant believes that, for reasons that are unavoidable and variables by virtue of their own nature, the right to oblivion is a right which is to be assessed on a case by case basis, on account of the characteristics of the informative content and/or data and/or information in general that is object of the debate and also taking into account that the purpose of the search engine is precisely facilitating access to information for users of predetermined communication infrastructures like internet. For that reason, any existing search engine known to date protects private citizens in a very weak way. When necessary and explicitly requested by users and/or by the courts and/or by the courts that are competent on the subject, the involved search engine does not delete, indeed, the information content at the data treatment owner, i.e. at the publisher of the information content itself, but only deletes the link to it. There is substantially no definitive deletion of the information content at the root, i.e. where the information content is stored, for example in databases, in newspaper archives or similar paper or electronic memories. As a consequence, to meet the users of the World Wide Web, the leading search engine (browsers) known to date, which is Google®, made a web form available through which interested parties can request the removal of the results that concern them (but there is no certainty that they succeed).
However, that Web module solves only a part of the aforementioned drawbacks because filling out the web form does not guarantee that the information content of the debate is deleted and the subject is not totally visible and accessible to those who consult the relevant information content. As a result, in many situations the person that is cited and/or quoted in the controversial information content, and his/her reputation do not benefit from the availability of such web form if his/her request is not accepted, for any reason, by Google®. In this situation, the unwanted and/or incorrect and/or unreliable information content remains online and is accessible to everyone, just as prior to the compilation of the web form, and thus all the above mentioned drawbacks occur.
The same considerations may refer to the context of the credit reporting. As of today many users, either natural or legal persons, make use of credit for a plurality of reasons. Credit granting is subject to analysis performed by credit rating institutions or companies, whose purpose is to provide indication, in particular a
-3certified indication, of whether the credit shall be granted or be further granted to the requesting user.
Such companies emit a credit report, typically a document associated to a specific user that keeps into account all the credit history of said user. Such a document may be used by a predetermined group of entities to analyze the credit situation of said user in order to get e.g. other credits.
In many cases, negative issuance of credit rating strongly affects the future credit granting also when further requests are made after a relevant amount of time.
AIMS OF THE INVENTION
The present invention aims to solve the problems and drawbacks discussed above with respect of the known art.
The invention aims to provide to the users of a data communications infrastructure a method for commenting content that affects users on the aforementioned data communications network or infrastructure, in particular when related to the subject-matter concerning credit worthiness.
The invention is particularly aimed at proposing a solution to a particularly felt problem of credit rating, wherein any undesirable consequence of a misinterpretation of some credit requirements that any individual may have had in the past, provide negative effects on the reputation of a natural or legal person in the subsequent future, also for a relevant amount of time.
The invention is aimed at individuals, by defending and protecting their reputation and their rights, at legal persons, by giving them a common and shared solution that is accessible to everyone (through the data communications network and in particular the web) and is able to avoid any possible negative consequences arising from the indexing of a unwanted or unsuitable negative information content about credit rating and/or worthiness.
These and others aims, which will become more apparent from the following description, are substantially achieved by a method, by a software or by a mobile application or by a computer or by a computer program, and by their use and, finally, by a system in accordance with what is expressed in one or more of the appended claims and/or of the following aspects, which can be considered alone or in any
-4combination with each other or in combination with any one of the appended claims and/or in combination with any of the additional technical features described below.

BRIEF DESCRIPTION OF THE DRAWINGS
Preferred and non-limiting embodiments of the invention will be disclosed in the subsequent portion of description with the help of the annexed figures wherein:
- Figure 1 is a schematic diagram of the system according to an embodiment of the invention; and
- Figure 2 schematically represents invention flow diagram according to an embodiment of the invention.
DETAILED DESCRIPTION OF THE INVENTION
Figure 1 shows a schematic view of a preferred and non-limiting embodiment for a system for managing information content related to a natural or legal person in a data communication infrastructure or network. The system according to the invention is specifically conceived for performing a new way of sharing electronic data concerning the credit that a predetermined user may require and/or obtain and is e.g. conceived to be used for providing comments about credit rating, worthiness or any other banking detail to credit rating companies or banking institutions providing credit to natural or legal persons.
The system 100 may comprise a server subsystem 101 in turn comprising a memory 102 storing the information content, that as it will be better clarified in the following part of the description concern the credit of a subject, of at least one and
-11preferably a plurality of subjects of interest 200, and an interface 103 for connecting the system 100 to a data communication network 104 that may be e.g. the Internet network.
In particular, the server subsystem 101 may have electronic access to a blockchain 105. The blockchain 105 may be configured for acting as a certification authority for at least part of the information content.
The data communication network 104 may be used and/or shared with other electronic entities not being part of the system relating to the invention, but in any case such communication network allows establishing a least a temporary electronic connection with electronic resources 300, 301 among which there are electronic resources of a credit rating company. As per “electronic resources”, in the context of the present invention shall be considered remote computers or computer networks, in particular remote computers or remote computer networks of a credit rating company or institution or banking institution, which are electronically connected to the data communications network 104 in such a way to be at least electronically temporarily accessible by said server subsystem.
With “information content” is meant any item, photos, videos, voice track, data of any nature containing information about at least one person of interest. Therefore, in the present context the information contents analyzed by the method in accordance with the invention, which will be hereinafter described and claimed, will be understood as relating to, and of potential and/or actual interest for, said subject of interest.
The subject of interest 200 may be a physical entity, such as a single person (also called user in the data communications network such as Internet) or a group of persons or a legal entity, such as an association or a foundation, or a company, or a newspaper, or a website, or a blog, or a forum, or the like.
Within the memory 102 of the server subsystem 101 at least one and preferably a plurality of files 106 is/are stored; each file may be univocally associated to a single subject of interest 200, e.g. may contain data specific relating to said subject of interest. According to a preferred and non-limiting embodiment of the invention, such data may include credit reporting data, i.e. data at least comprising the credit history and/or credit worthiness of a specific subject of interest 200. The subject of interest 200 is preferably provided with an own electronic device 201, for
-12example a personal computer, tablet, cellular mobile device or other type of electronic device, in order to electronically access the server subsystem 101 through establishing an electronic connection therewith. Albeit figure 1 shows a single subject of interest 200, such a specific number shall not be considered as a limitation for the purposes of the present invention. In particular, server subsystem 101 may comprise means suitable to allow connection, in particular a simultaneous electronic connection, of a plurality of subjects of interest 200.
Each subject of interest 200 may access only to the file or files 106 univocally associated thereto, and does not possess any electronic permission of reading, writing or deleting data of other files 106 which are univocally associated to other subjects of interest 200. For such a reason, the server subsystem 101 may comprise a data processing unit specifically configured for allowing selectively electronically accessing the files 106 which are stored in the memory 102. More in detail, the data processing unit may comprise electronic comparison means for verifying the matching of credentials inputted by a specific subject of interest 200 to credentials which are stored for files 106 in the memory 102, and for providing access only to the file 106 whose associated credentials correspond to the credentials inputted by the subject of interest.
Each subject of interest has a right to modify, in particular by electronically adapting and storing, at least one parameter on said server subsystem 101 and, more specifically, on said the file 106 associated thereto: said parameter may comprise electronic selective reading authorization for said file 106. In particular, the electronic selective reading authorization may comprise a plurality of names, or codes or links to electronic resources which are allowed to read the file 106. For example, and in a non-limiting extent, the electronic resources 300, 301 that may be authorized to read the file 106 may comprise electronic computers of a banking institution, or employer, or tax consultant, or - as already mentioned - the credit rating company or institution.
The server subsystem 101 may be configured to perform a step of automatically retrieving electronic information content about a specific subject of interest 200 at the moment of his electronic subscription on the system 100. Such a step, which in the flow diagram of figure 2 is shown in box referenced with reference number 1002, may comprise electronically enquiring a plurality of electronic
-13resources outside the system 100, preferably a blockchain 105, and downloading on the memory 102, in particular on the file 106, a first available version of credit reporting data for the specific subject of interest 200. Electronic resources outside the system but still in the data communication network 104 are referred in the annexed figures with the reference numbers 300, 301. More in detail, the enquiring comprises electronically contacting one or more databases and/or server and/or service provider and/or websites of said electronic resources 300, 301 in order to electronically verify the possible existence and/or availability of an additional information content related to at least one specific subject of interest 200, and, in particular, the additional information content is related to said information content of interest by means of at least one or more sensible information, such as: the name of a physical person and/or the name of a legal person and/or a topic of interest, and in particular the additional information content being a reply report and/or commenting report to at least a part of the information content retrievable by means of said link or reference address. Referring to the flow diagram of figure 2, the enquiring is performed after at least a first subject of interest 200 electronically registers on the system which comprises the server subsystem 101 (block 1000), and - more in detail - after at least some data are stored within the server subsystem 101 (block 1001). Operations according to block 1001 and block 1002 may be performed for each of the subjects of interest 200 which register to the system. Electronic data which may be stored by the subject of interest 200 in the file 106 include at least one among: the name, surname, address, credit card number, account details, fiscal code, VAT code, country of residence, marital status, comments on credit worthiness, etc. In other words, the method may comprise a phase that provides for the definition of a subject of interest 200 with respect to which searching and/or analyzing, in particular electronically and through a data processing unit, information content available on the data communications network 104. Such a subject of interest 200 may be chosen among those to which at least one file 106 of the memory of the server subsystem 101 is associated.
The enquiring may include providing to the electronic resources which are enquired at least part of the electronic data which have been provided by the subject of interest 200 at the moment of subscription, e.g. at least one among the name, surname, address, credit card number, account details, fiscal code, VAT code,
-14country of residence, marital status, previously filed comments on credit worthiness, etc.
Once the electronic resources 300, 301 are enquired for the first time, such electronic resources may perform, particularly by means or through an automated electronic procedure, automatically updating or loading credit reporting data on the server subsystem 101, in particular the memory 102, by e.g. uploading or updating new data on the file 106 which is associated to a specific subject of interest 200 and in particular to the specific subject of interest 200 whose data and/or information were object of the enquiry. Such an operation is briefly disclosed in figure 2 with box 1003. Once the uploading is completed, preferably but in a non-limiting extent, the server subsystem 101 may be configured to automatically perform a step of electronic notification of the subject of interest 200 to which the file 106 is univocally associated with e.g. an SMS and/or an e-mail and/or any other suitable transmission channel or protocol, in order to make the subject of interest promptly aware that some data has been changed.
According to a preferred and non-limiting embodiment, the file 106 may have electronic fields that may be edited by the subject of interest. Such electronic fields may contain comments relating to the credit reporting data and/or modifications thereof. Such fields, also for the electronic data that the user first stores in the at least one file 106 allow for having a structured introduction of data in the file, which simplifies the search and retrieval of information and further allows for performing faster searches over the whole set of electronic resources 300, 301 in the communication data network 104.
In particular, it shall be noted that when the communication network 104 comprises a vast plurality of electronic resources 300, 301, retrieval of information among the electronic resources 300, 301 of the communication network 104 may comprise parallel interrogating a plurality of electronic resources 300, 301 at the same time and/or enhancing the search with data already provided by other electronic resources of the network.
Preferably, through known electronic user interfaces, the subject of interest 200 may authorize the server subsystem 101 to publish the comments that he has edited on the fields of the file 106, and in particular may authorize the server
-15subsystem 101 to distribute those comments together with the file 106 to the electronic resources which are allowed to read the file 106.
The comments are actually electronic comments that may be appended to the file 106 by a specific subject of interest 200, if so enabled, in a step of exhibiting, replying, its version, opinion or personal truth on the information content which has been transferred to the file 106 as previously described.
In a preferred and non-limiting embodiment, the server subsystem may provide templates for comments editing, operatively associated with the file 106, in such a way to make easier for the subject of interest 200 appropriately append the relevant comment in the right position of the file.
This means that the credit reporting companies which today may be characterized by negative reputation could enhance this latter since offering to subjects of interest the possibility to introduce in the credit report comments about their credit worthiness may produce a more equilibrated and complete information.
Other users that may have electronic access to the server subsystem 101, may access to the file 106 of a particular subject of interest 200 through the payment of a prescribed electronic fee, in particular by means of a step or series of steps that comprises creating an electronic account on the server subsystem 101, providing details about which - amongst the subjects of interest are registered, in particular electronically registered or otherwise enrolled to the server subsystem 101 and/or have files 106 stored in the server subsystem 101, and further comprise providing payment of a prescribed fee for downloading at least one file 106 from the memory of the server subsystem 101, said step of downloading being performed after a predetermined transaction for the fee is made.
From the side of the credit reporting companies, it may be present a step of definition of at least one and preferably a plurality of evaluation parameters for a related information content and/or related to at least one subject of interest. In addition to the above-described step, or alternatively thereto, the method may include a step of definition of a global evaluation parameter of said information content. Such a parameter may be used by the credit reporting company to choose if further providing credit to a specific subject of interest 200.
The search and/or selection of information content can be performed automatically, for example by means of a software (which will be hereinafter
-16described) which carries out the enquiry, which can be programmed and/or programmable or configurable by a user, in particular by an administrator of the server subsystem 101.
Credit rating companies and/or banking institutions, through their own electronic resource, may automatically evaluate the information provided by the specific subject of interest 200 and/or by other electronic resources 300, 301 using at least a calculation algorithm, to obtain a plurality of values for the respective parameters of evaluation of the information content, or a (single and/or global) value to the global evaluation parameter of the information content. The global value of the global evaluation parameter of the information content can be obtained by one (optional) step of the method which provides for processing the values of the evaluation parameters by means of a global calculation algorithm, within which such evaluation parameters can have the same weight, or differ from each other in weight, some parameters of evaluation of the information content being considered more significant or important than others.
The credit rating companies may therefore perform a step of comparison and/or evaluation. This step consists in comparing the global value of the global evaluation parameter or the single values obtained for each evaluation parameter with respective the interval(s) of acceptability of the parameter(s).
Detailing the phase that has been just described, it should be understood that storing of previously analyzed information content can take place at least in the case where the global value of the global parameter is outside the range of acceptability, or in the case where a predetermined number of values of the individual parameters are outside their respective ranges of acceptability of predetermined extent. In case the global value of the global parameter is outside the range of acceptability, further credit to the specific subject of interest 200 may be denied.
In a variant, the storage of one or more information content can also take place before (or both before and after) the steps of evaluation and/or comparison, for example on the basis of automatic criteria and/or criteria which are configurable by a user of the data communications network, for example by the subject of interest itself or by a user authorized by the subject of interest.
It has been said that electronic resources may be authorized to automatically update the credit reporting data on the server subsystem 101, in particular the
-17memory 102, by e.g. uploading new data on the file 106 which is associated to a specific subject of interest 200. The method therefore comprises making available the information content or for an evaluation of the information content by a user, and preferably by the subject of interest 200 or by a person authorized by, or connected to, the subject of interest.
A further step of the method comprises a step of providing an interface configured to allow the step of appending the data that the specific subject of interest wants to associate to the file 106. Said step of provision of the interface is performed by the server subsystem 101, and is performed in such a way that the specific subject of interest 200 is given the possibility to guidedly append electronic information to the file 106, i.e. in such a way that any adaptation or modification of the file 106 through the comments that the specific subject of interest 200 wants to append is performed in predetermined parts of the file.
On the electronic device 201 provided to or already in possession of the subjects of interest 200, in a preferred and non-limiting embodiment may be stored a suitable software application or software program conceived specifically for the purpose of allowing the device 201 connect to the server subsystem 101 in a way to render possible the electronic communications previously described.
In particular, said software program may be configured to make an electronic device 201 provided to a predetermined subject of interest 200 establish an electronic connection with a server system 101.
Through said electronic connection, said electronic device 201 is capable of transmitting electronic information content specifically correlated to said predetermined subject of interest 200 to a memory 102 associated to the server system 101 through said electronic connection.
The software program is further configured to cause the server system 101 automatically enquire a plurality of predetermined electronic resources 300; 301 among which there is said credit rating company, by means of the server subsystem 101 and/or by providing at least a part of electronic information content previously electronically provided by said specific subject of interest 200 to said sever unit 101, for storing on the memory 102 associated to the server system 101 at least part of further information content specifically correlated to the predetermined subject of interest 200. The software program further allows through the electronic connection
-18with the server system 101, transmitting further electronic data, e.g. comments provided by the subject of interest, on said memory 102 in particular to at least one file 106 on said memory 102 where the further information content was stored upon transmission from said predetermined electronic resources 300, 301.
The software program may be further configured to store, preferably in a secured way, at least part of the access credentials that the predetermined subject of interest may use in order to log-in on the server subsystem 101 in such a way to electronically access to the file 106 to which is associated.
Applicant noticed that information concerning the credit or credit worthiness of a single or of a plurality of subjects of interest 200 may be particularly sensitive in terms of privacy of actual data concerned, and may influence aspects of the future life of the subject of interest that may be of particular relevance if not of a paramount relevance. For such a reason, the predetermined electronic resources 300, 301 with which the server subsystem 101 may establish an electronic connection may be connected securely in order to prevent fraudulent introduction on the connection, or sniffing, or anyway any fraudulent data pickup that may result in an unwanted loss of privacy or confidentiality of data. For such a reason, according to a preferred and non-limiting embodiment, the invention may be configured in such a way that the data communication network 104 may support secure protocols for data transmission like TCP/IP, that in turns hosts - at application level - HTTPs or any other suitable secured electronic data transfer protocol with which the electronic resources 300, 301 may be enquired by the server subsystem. The same applies for the electronic communication channel that the electronic devices 201 provided to the subject of interest 200 may be provided with.
In particular, the software and/or mobile application and/or computer program or computer configured to allow the implementation of the method of analysis of information content on a data communications network may be the same software and/or mobile application and/or computer program or computers aimed at implementing the previously described method for managing information content on a data communications network.
-19ADVANTAGES OF THE INVENTION
Among the advantages of the method and system herein disclosed in a preferred and non-limiting embodiment there is to allow at least one and preferably a predetermined number of subjects of interest express opinions about the important information concerning the credit reporting or financial situation, that is generally correlated to the credit rating. Therefore, the credit rating companies may flank the algorithms they use to provide a rating for a specific user with relevant data provided by the subject of interest 200, and getting knowledge of the reason for which the rating is actually so.
Applicant in particular submits that, for a specific subject of interest 200, expressing through comments on the file 106 the reasons about some aspects of his credit worthiness, does not necessarily implies that he or she will receive further credit or that the credit rating will be increased. The system and the method object of the present invention will help people which finalize the decision about whether or not granting further credit to the specific subject of interest 200, will at least know the motivation for which an actual solution of bad credit is present, and will decide eventually more wisely. For instance, he will get knowledge that some credit was required by a subject for paying health costs and that today, when the illness is healed, the subject will be capable of actually paying back the debit. The subject that will decide whether or not give further credit to the specific subject of interest, should be less prone to think that credit was asked in order to pay casino games.
Through the system and method herein described, subjects of interest will have the chance to reply to the information content in a simple, direct, effective way, shared on the data communications network (i.e. accessible to a plurality of other users utilizing the data communications network).
The invention is also advantageous not only for the users as outlined above (with extremely positive effect on their reputation and reliability on the communications infrastructure), but also for the for the banking institutions and credit rating companies, which will no more only offer a simple indexing of information content related to a specific person, but a more complete and trustful service. Furthermore, the invention may also be implemented in combination with social medias, through which it is nowadays common that episodes of denigration occur.
-20In addition, the invention allows anyone to know and read easily and effectively both all the contents that are available on the world wide web about a specific person, but also the location, the considerations and the truth of this person with regards to that content. In particular, this will be possible by the use of a single software or mobile application or website.
Moreover, whoever feels the need to reply to a specific content published or anyway electronic provided by a banking institution or credit rating company about him/her, can leave a certified comment connected thereto.
In addition, anyone who wants to quickly and neutrally analyze some aspects such as diffusion, authenticity, degree of defamation and cloud of words relating to a specific web content can do it easily and immediately by the method and the software in accordance with the invention.
The invention finally protect the freedom of expression, the right to personal identity and the rights of the community so that everyone can find complete and updated information regarding each subject in the data communications network, that may eventually be diffused through the Internet network.
Parts of the process and system above disclosed may be - when suitable be realized through a data processing unit, technically interchangeable with one or more electronic computers conceived and/or configured for executing portions of software or firmware programs loaded on a non-transitory memory support. Said software program may be written in any programming language. The electronic computers, if two or more, may be electronically connected each other by means of a data exchange network and they may share they computation power; the electronic computers of the server subsystem may be therefore arranged in geographically different positions.
The data processing unit may be a general purpose processor specifically configured to perform - through the software program - at least part of the steps of the previously described method, or it may be an ASIC or dedicated processor, specifically designed to perform at least part of the steps of the previously described method.
The non-transitory memory support may be in particular physically internal or external with respect to the server subsystem 101 and or to the processor, and in particular it may be physically divided therefrom, in a form of a “cloud” memory.
-21It is finally clear that to the system and method object of the invention many adaptations or additions can be made, without for this departing from the scope of protection provided by the annexed claims.
