Detailed Description
The following description of the technical solutions in the embodiments of the present application will be made clearly and completely with reference to the accompanying drawings in the embodiments of the present application, and it is apparent that the described embodiments are only some embodiments of the present application, not all embodiments. All other embodiments, which can be made by one of ordinary skill in the art without undue burden from the present disclosure, are within the scope of the present disclosure.
Some embodiments of the present application are described in detail below with reference to the accompanying drawings. The following embodiments and features of the embodiments may be combined with each other without conflict.
The terms "first," "second," and the like in this application are used for distinguishing between different objects and not for describing a particular sequential order. Furthermore, the terms "comprise" and "have," as well as any variations thereof, are intended to cover a non-exclusive inclusion. For example, a process, method, system, article, or apparatus that comprises a list of steps or elements is not limited to only those listed steps or elements but may include other steps or elements not listed or inherent to such process, method, article, or apparatus.
Reference herein to "an embodiment" means that a particular feature, structure, or characteristic described in connection with the embodiment may be included in at least one embodiment of the present application. The appearances of such phrases in various places in the specification are not necessarily all referring to the same embodiment, nor are separate or alternative embodiments mutually exclusive of other embodiments. Those of skill in the art will explicitly and implicitly appreciate that the embodiments described herein may be combined with other embodiments.
If the technical scheme of the application relates to personal information, the product applying the technical scheme of the application clearly informs the personal information processing rule before processing the personal information, and obtains independent consent of the individual. If the technical scheme of the application relates to sensitive personal information, the product applying the technical scheme of the application obtains individual consent before processing the sensitive personal information, and simultaneously meets the requirement of 'explicit consent'. For example, a clear and remarkable mark is set at a personal information acquisition device such as a camera to inform that the personal information acquisition range is entered, personal information is acquired, and if the personal voluntarily enters the acquisition range, the personal information is considered as consent to be acquired; or on the device for processing the personal information, under the condition that obvious identification/information is utilized to inform the personal information processing rule, personal authorization is obtained by popup information or a personal information peer-to-peer mode of requesting the person to upload the personal information; the personal information processing rule may include information such as a personal information processor, a personal information processing purpose, a processing method, and a type of personal information to be processed.
As knowledge of intellectual property rights is gradually improved by enterprises, the patent rights of enterprises are more and more concerned and paid attention to. Enterprises apply for multi-dimensional patent applications to produced commodities to comprehensively protect technologies related to the commodities.
However, the patent and commodity of the enterprise often exist independently, which is inconvenient for the enterprise to uniformly analyze the commodity and related patent. For example, patent application files of enterprises are stored in folders, and the folders are distinguished by commodity names, so that the contents of the patent application files are inconvenient to browse, and the overview of patents related to commodities is inconvenient. For example, each part of the commodity may correspond to a patent applied, so that no intuitive system can directly acquire the commodity and the patent related to the part included in the commodity, and then, for example, a professional may be required to analyze the applied patent before an administrator of an enterprise can know the value of the patent on the commodity, for example, the intuitive acquisition of the influence of the patent application on the sales of the commodity is inconvenient. To solve or improve the above problems, the present application proposes the following embodiments.
As shown in FIG. 1, the intellectual property system described in the embodiments of the intellectual property system of the present application may centrally manage intellectual property topics. Intellectual property topics may be the subject of analysis of the relevant content of the intellectual property. There are many scenarios in the intellectual property work where analysis of the intellectual property content is required, for example, in the case of patent layout work, infringement disputes, patent right maintenance, etc., or investigation of products by companies before developing new products, etc., for example, investigation subjects of patents related to a certain type of air conditioner may be used. The related content of the intellectual property may be related patents or data analysis reports obtained by analyzing the related data of the intellectual property, etc.
Intellectual property topics may be created in an intellectual property system to centrally manage a number of intellectual property topics. Several intellectual property topics may constitute a topic library. In one embodiment, after entering the intellectual property system, the first page of the intellectual property system may display a plurality of topics in a topic library.
When the number of topics in the intellectual property system is excessive, it may be disadvantageous to quickly find the target topic. Therefore, in order to improve the efficiency of inquiring the target topics, topics can be classified so as to classify intellectual property items according to business scenes or business types. According to actual intellectual property work conditions, business scenes can be divided into high-value patent culture layout, product marketing/export risk control, infringement disputes, patent maintenance rights, IPO marketing, patent checking and operation, science and technology and important standing patent navigation and competitor threat peer-to-peer. Business types can be categorized into corporate surveys, product surveys, technical surveys, infringement risk investigation, infringement comparison analysis, avoidance design analysis, patent invalidity/stability analysis, patent value assessment, industry surveys, policy and market environment analysis, patent monitoring, patent mining.
For each topic displayed on the top page, a button corresponding to the topic can be selected to enter data related to the topic, related data analysis reports and the like. For example, a topic name may be clicked into a topic interface. The topic interface may display a list of patent documents related to topics, a list of analysis reports made on topics, or the like.
For each patent document displayed on the thematic interface, the patent detail interface of the patent document can be accessed by selecting a button corresponding to the patent document. The patent details interface may display details of the patent, such as basic information of patent documents, claims, drawings, specification text, patent families, legal status, derived documents, license history, review history, invalidation records, litigation history, other references, and the like.
In order to solve the foregoing technical problems, an entry may be provided in an intellectual property system to associate an intellectual property file under a topic with a commodity/service/work, the intellectual property file may be a patent, a trademark, a copyright, or the like; of course, the association of the intellectual property file with the goods/services is not limited to the above-described intellectual property system, and may be a direct independent of the association of the intellectual property file with the goods/services/works. Specifically, the association of the intellectual property file with the goods/services will be described in detail taking the above intellectual property system as an example.
As shown in fig. 2, a first embodiment of a method for associating an article of commerce with a patent of the present application may include the steps of: m100: receiving a first instruction, wherein the first instruction is used for entering a thematic library interface, and the thematic library interface displays at least one theme; m200: responding to the first instruction, and displaying a topic library interface; m300: receiving a second instruction, wherein the second instruction is used for entering a thematic interface, and the thematic interface displays a patent list related to the thematic; m400: responding to the second instruction, and displaying a thematic interface; m500: receiving a third instruction; m600: responding to a third instruction, displaying a patent detail interface of the selected patent in the patent list, wherein the patent detail interface is used for displaying a commodity list or selecting the patent in the patent list; m700: receiving a fourth instruction, wherein the fourth instruction is used for establishing association between at least one commodity in the commodity list and the selected patent; m800: in response to the fourth instruction, associating at least one commodity with the selected patent; m900: receiving a fifth instruction for displaying commercial data of the commodity, the commercial data including sales time, and at least one of sales amount, sales profits, patent licensing fees, patent evaluation value; m1000: in response to the fifth instruction, the business data is displayed.
By displaying the intellectual property related conditions of the commodities/works through a preset flow and an interface, enterprises or individuals can intuitively acquire the intellectual property related conditions of the commodities/works so as to assist the enterprises or individuals to correctly and comprehensively make related business decisions.
A first embodiment of a method for associating an article of commerce with a patent of the present application is described in detail below.
M100: and receiving a first instruction, wherein the first instruction is used for entering a thematic library interface, and the thematic library interface displays at least one theme.
M200: and responding to the first instruction, and displaying a topic library interface.
As previously mentioned, topics may refer to the subject matter of analysis of patent projects. A topic may include several patent documents associated with the topic, or multiple reports based on analysis of the several patent documents. After the user selects to enter the intellectual property system through registration or login and the like, the client can receive a first instruction for displaying the thematic library interface, and the thematic library interface can display at least one theme on a display screen in response to the first instruction. The first instruction may be generated by the user through registration or login, or by the user operating after entering the intellectual property system.
As shown in fig. 1, the client may display a thematic library interface in a display screen. Wherein the thematic library interface may display the first area 10 and the second area 20 simultaneously or separately, the first area 10 may be used to display a number of selectable scenes belonging to the first dimension and a number of selectable types belonging to the second dimension, and the second area 20 may be used to display a theme contained in the scene and/or type selected by the first area. The first dimension and the second dimension are used to represent the distinction between the classification emphasis points.
Alternatively, the method for displaying the first area 10 and the second area 20 respectively may be "drawer display", that is, the first area 10 or the second area 20 is in a "folded" state when not in use, and only a part of the content in the area is displayed; when the user needs to use the area, the user can 'unfold' the area through the human-computer interface, and the unfolded area displays complete content and functions and is partially overlapped with the original other area which is not folded in the first interface, namely, the partial content of the other area is covered. Alternatively, the first region 10 or the second region 20 may be side by side and independent of the other region, or may overlap entirely or partially with the other region, or be a part of the other region.
Alternatively, the first area 10 may display the number of topics that have been created under each scene and the number of topics that have been created under each type, where the sum of the number of topics that have been created under each scene is equal to the sum of the number of topics that have been created under each type, i.e., the number of topics in the database.
Optionally, a third area 30 may also be displayed simultaneously or separately on the thematic repository interface, and the third area may be used to access the merchandise management interface or the visualization platform interface. Referring to the upper right corner area of fig. 1, a user may access the merchandise management interface or visualization platform interface by clicking on the merchandise management portal 31 or visualization scene portal 32.
In the commodity management interface, commodities/works related to intellectual property works may be managed. As shown in fig. 3, a list of goods may be displayed in the goods management interface. The commodity list includes commodities/works created in the intellectual property system. The business or individual may create goods/works in the goods management interface by adding a goods button 312 to centrally manage the responsible goods/works. The created goods/works may be displayed in a list of goods. The commodity category may be created in the commodity management interface by the new commodity category button 311, or the information of the commodity/work in the commodity list may be edited by the edit button. The query button 313 can query for the goods/works in the goods list.
Because the merchandise/works may have multiple families or include multiple components, in some scenarios, an enterprise or individual may also need to manage and analyze each family or each component of the merchandise, and thus the intellectual property system also provides a merchandise architecture interface portal 315 (see FIG. 4) through which the merchandise architecture interface 315 may be accessed. Clicking on the operation button 314 in fig. 3, for example, may display multiple entries. Each portal may display a corresponding functional interface. At the merchandise architecture interface, the user may create branches for the merchandise/work. For example, referring to fig. 5, in the commodity architecture interface where the commodity is a cell phone, branches of various models are created. The gray button "series 1" in the figure indicates that the area of the merchandise architecture interface displaying the architecture details is displaying information about series 1. Clicking on button "commodity 1" in the figure may also display detailed information about commodity 1. Wherein commodity 1 belongs to a commodity of series 1.
More importantly, the merchandise management interface also provides a business data portal so that businesses or individuals can add business data to the merchandise/work in the intellectual property system, which can be the time of sale, profit on sale, patent licensing fees, patent valuation, etc.
In addition, after entering the visual platform interface through the visual scene portal 32 of the thematic library interface, the intellectual property information of each commodity/work in the intellectual property system and the specific commodity/work included in the architecture thereof can be obtained. For example, the visualization platform interface may hierarchically display the number of patents associated with all goods/works in the goods management interface. In this manner, an enterprise or individual may utilize the intellectual property system to obtain an overview of the intellectual property related status of a commodity associated with the enterprise or individual, thereby providing data support for the intellectual property work direction behind the enterprise/individual.
Alternatively, in addition to the aforementioned association of the commodity/work with the topic library at the patent detail interface, the topic library may be associated with the commodity/work at the topic library interface, and after the topic library is associated with the commodity/work, the patent or analysis report included in the topic library may be associated with the commodity/work. The operation of associating the topic library with the commodity/work may be completed when the topic library is newly created, or may be completed when the topic library information is edited. For example, for the previously established patent library, but not for the product association operation, the "edit" key of the corresponding patent library can be clicked, the "thematic library information" page is entered, and the corresponding "related commodity", "commodity architecture" and "whether to sort" labels are supplemented, so that association with the corresponding commodity can be performed.
After clicking or selecting the newly added topic pool button 25 in the second area 20 of the topic pool interface shown in FIG. 1, the newly added topic pool interface can be displayed. As shown in fig. 6, the new thematic library page has options of "related goods", "goods architecture" and "whether to sort", and the corresponding goods/works added to the intellectual property system, that is, the goods/works of the goods list in the goods management interface, are selected at the "related goods". And a corresponding commodity architecture, wherein the commodity architecture can be a certain model or a certain specific component of a commodity associated with the thematic library. I.e., the model or component added to the aforementioned commodity architecture interface. After the topic library interface associates the topic library with the commodity, the patent list 21 (see fig. 7) of the commodity associated with the topic library may be displayed with the patent and analysis report included in the topic library. Patent list 21 displays all intellectual property files such as patents and analysis reports associated with the merchandise.
The "sort or not" option is used to sort patents associated with the subject library based on the commodity architecture. If the information of the commodity architecture added to the commodity management interface is selected to be classified, the information can appear at the patent indexing position of the topic library, the related patents in the topic library can be directly classified according to the commodity architecture, and the indexed patents can be automatically updated to the list and the quantity of the related commodity architectures of the visual platform interface of the commodity management interface; if no classification is selected, information of the commodity architecture does not appear in this topic library.
Alternatively, the patent related to the commodity/work mentioned in the above may be a patent/copyright related to the commodity/work, an analysis report related to the commodity/work, or a document that may provide a reference meaning for the intellectual property status of the commodity/work, for example, a patent document or a report document of the commodity/work having a competitive relationship or a potential value with the commodity/work.
M300: and receiving a second instruction, wherein the second instruction is used for entering a thematic interface of the thematic, and the thematic interface displays a patent list related to the thematic.
M400: and responding to the second instruction, and displaying a thematic interface.
As previously mentioned, the intellectual property system may help businesses or individuals to centrally manage the content of intellectual property related works. Based on this, the thematic library interface displays a thematic list comprising at least one theme. Each item of topic data in the topic list has a corresponding operable item that can enter the topic interface of the topic. The thematic interface displays intellectual property data related to the themes, such as patent or copyright or related data analysis reports, etc. The actionable items may be various controls such as buttons of the current interface, options displayed after a right click of a mouse, touch-activated content, or links, among others.
After the enterprise or the person enters the thematic library interface, clicking the operable item corresponding to the thematic, the client can receive the second instruction, and responding to the second instruction, the thematic interface can be displayed. When the data of the intellectual property system is stored in the server, the client receives the second instruction and then sends the second instruction to the server. The server may generate content of the thematic interface in response to the second instruction and transmit the content to the client so that the thematic interface may be displayed based on the content of the generated thematic interface.
M500: a third instruction is received.
M600: in response to the third instruction, a patent detail interface of the selected patent in the patent list is displayed, and the patent detail interface is used for displaying the commodity list or selecting the patent in the patent list.
Each patent data in the patent list is provided with a corresponding operation item or the data itself can enter a patent detail interface of the patent by self-contained link. As shown in fig. 8, the item selection area 22 in the patent detail interface may display a list of items, or there may be an operable item that can be triggered to open the list of items. The items in the list of items may be added in advance by the business or individual in the items management interface.
In one embodiment, the user may enter the patent details interface from a list of patents in the thematic interface, and select in the item selection area 22 displayed in the patent details interface (see fig. 8) to associate the selected item with the patent corresponding to the patent details interface.
In another embodiment, the user may associate the patent with the merchandise directly at the thematic interface. For example, the client responds to the third instruction to select a patent in the patent list so as to directly associate the patent with the selected commodity at the thematic interface.
After the enterprise or the individual selects the patent in the thematic interface, the client receives a third instruction, and the patent detail interface of the selected patent in the patent list is displayed on the client in response to the third instruction. When the data of the intellectual property system is stored in the server, the client receives the third instruction and then sends the third instruction to the server. The server may generate content of the patent detail interface in response to the third instruction and transmit the content to the client so that the patent detail interface may be displayed based on the content of the generated patent detail interface.
Optionally, the patent details page may display details of a patent, such as the content of a patent application document, or commodity data of related commodities, in addition to the commodity selection area 22 for selecting commodities, and specifically, the following steps included in M600 may be referred to:
M610: and displaying a plurality of operable items of the selected patent, wherein part of the operable items are used for entering a page of basic information of the selected patent, the basic information comprises at least one of claims, drawings, description text, patent of the same family and legal status, and the other part of the operable items are used for entering a page of commodity information associated with the selected patent.
As shown in fig. 8, the patent details interface includes the patent number, patent name, etc. of the patent, information identifying the patent, and several operational items. Among the several operable items, some of the operable items may be used to access pages of basic information of the patent, such as accessing a page to display claims of the patent. Wherein the page may be a sub-page of the patent details page. Another part of the operable items may be used to enter a page of merchandise information associated with the patent, for example, one of the other part of the operable items may be used to enter basic information (merchandise name, category) of merchandise associated with the patent, for example, another one of the other part of the operable items may be used to enter a page of merchandise information showing merchandise associated with the patent, which may be at least one of sales time, sales data, patent licensing fee, patent evaluation value, and the like. The commercial information can be displayed in a list form or in a graph or numerical form.
Optionally, after entering the patent detail interface, in addition to displaying the information identifying the patent, such as the patent number and the patent name, and the several operable items, the default may also display a page corresponding to one of the several operable items, so as to reduce a blank area of the patent detail interface when the patent detail interface is just entered, and specifically, see the following steps included in M600:
m620: displaying a plurality of operable items of the selected patent, and displaying a page corresponding to one of the operable items by default on the same interface on which the plurality of operable items are displayed.
For example, after entering the patent detail interface, the basic information of the patent is displayed by default, which may be information such as application number, application date, abstract drawing, etc.
Optionally, as shown in fig. 9, some of the several operable items of the patent detail interface may be used to display the merchandise category information area 23 and/or the merchandise detail information area 24 of the merchandise associated with the patent. The commodity category information comprises at least one of a commodity category, a reference permission rate and a commodity category creator, the commodity detail information comprises at least one of a commodity name, commodity marketing time, a commodity company, a reference permission rate and a commodity description, and the commodity category can be added in an newly added commodity category interface of the intellectual property system; the commodity name is a specific commodity which needs to be added at this time; the commodity marketing time is the first day of the commodity to be released or marketed; the company to which the commodity belongs can default to the company, and can also be a foreign company; the reference license rate is a fixed proportion, and the rate value of the license history of the commodity related patent in the market can be obtained from the case of the highest hospital; "commodity description" is a supplementary description of the commodity; see, in particular, the following steps after M600:
M630: a sixth instruction is received, the sixth instruction for selecting another portion of the plurality of operational items.
M640: in response to the sixth instruction, if the sixth instruction is an operable item that triggers the merchandise category information interface and/or the merchandise detail information interface, the merchandise category information interface and/or the merchandise detail information interface is displayed.
In step M600, an embodiment of associating a patent with an item in the list of items, i.e., associating a patent with an item that has been added in the intellectual property system, is described. The commodity information in the commodity list may be presented by reading commodity information that has been added in commodity management. For the need to associate patents with goods that are not added in the goods management interface, the present application may fulfill the need by operating on the goods category information interface and/or the goods detail information interface.
The commodity category information and the commodity detail information may be displayed on the same interface. One operable item may display commodity category information and the other operable item may display commodity detail information.
After the enterprise or the individual selects the operable item triggering the commodity category information interface and/or the commodity detail information interface in the patent detail interface, the client side can receive a sixth instruction and respond to the sixth instruction to display the commodity category information interface and/or the commodity detail information interface. When the data of the intellectual property system is stored in the server, the client receives the sixth instruction and then sends the sixth instruction to the server. The server may generate content of the commodity category information interface and/or the commodity detail information interface in response to the sixth instruction, and transmit the content to the client so that the commodity category information interface and/or the commodity detail information interface may be displayed based on the content of the generated commodity category information interface and/or commodity detail information interface.
Through operating the operable items corresponding to the commodity category information interface and the commodity detail information interface, a user can conveniently and directly obtain information of commodities associated with the patent at the patent detail interface, so that the intellectual property condition related to the patent can be intuitively known, and the value of the patent can be further obtained.
Alternatively, the items in the item list are items that have been pre-saved in the intellectual property system. For a commodity that is not saved in the intellectual property system, the commodity is not displayed in the commodity list. Thus, in order to enable the user to associate a patent with an item that does not appear in the item list at the patent details interface, the present application proposes the following embodiments, see specifically the following steps included in M640:
m641: displaying a first operable item, wherein the first operable item is used for displaying an newly added commodity category interface, the newly added commodity category interface is used for adding commodity categories, and/or displaying a second operable item, the second operable item is used for displaying a newly added commodity detail interface, and the newly added commodity detail interface is used for adding specific commodities.
As shown in fig. 9, a first operable item 231 is displayed in the commodity category information interface or commodity category information area 23, and an additional commodity category interface (refer to fig. 10) can be displayed by operating (e.g., clicking) the first operable item 231. The newly added commodity category interface may be used for newly added commodity categories, such as mobile phones, which may be synchronized to the total commodity categories stored in the intellectual property system, i.e., the newly added commodity categories may be displayed in the commodity list.
As shown in fig. 9, a second operable item 241 is displayed in the item detail information interface or item detail information area 24, and operating (e.g., clicking) on the second operable item 241 may display an additional item detail interface (see fig. 11). The newly added commodity detail interface can be used for newly adding commodity detail information, namely adding specific commodities associated with patents, such as a mobile phone with the model xx 001. The newly added specific commodity can be synchronized to the commodity collection saved by the intellectual property system, namely the newly added specific commodity can be displayed in the commodity list.
Optionally, to facilitate the user operating on the merchandise associated with the patent at the patent details interface, the merchandise category information interface and the merchandise details information interface may provide an operable item, such as a button, for editing merchandise information by an enterprise or a person, and in particular, see the following steps included in M640:
m642: and displaying a third operable item for querying at least one commodity category associated with the selected patent.
More than one commodity category associated with a patent may be associated, for example, a patent associated with a certain display screen may be associated with both a mobile phone and a television, and if there are multiple commodity categories associated with a patent, a great deal of time is wasted if each commodity category information is to be confirmed to find the target commodity category. Therefore, the third operable item 232 is provided in the commodity category information interface, and operating (e.g. clicking or directly inputting a query keyword) the third operable item 232 can query the commodity category information in the commodity category information interface, so that the user can quickly obtain the information of the target commodity category from a plurality of commodity categories.
M643: displaying a fourth operable item, wherein the fourth operable item is used for editing commodity category information of at least one commodity category associated with the selected patent.
The commodity category information may include commodity category names, reference licensing rates, patent valuation values, creator, or remarks. After creating a commodity category, the user may also need to modify the information of the commodity category. Based on the requirement, the commodity category information interface may be provided with a fourth operable item 233, and operating (e.g., clicking) the fourth operable item 233 may edit the commodity category information, or click editing directly on the commodity category information. For example, after clicking the fourth operable item 233, the edited product category information interface may be popped up for editing by the user, and after the user finishes editing, the edited product category information interface is closed, and the product category information of the product category information interface is updated to the edited product category information.
The above is a description of embodiments that can be made on the commodity category information interface, and the commodity associated with the patent may be detailed to a certain model or a certain specific component, so the present application provides a commodity detail information interface, and reference is made to the following description of the commodity detail information interface.
M644: and displaying a fifth operable item for querying at least one commodity associated with the selected patent.
More than one patent may be associated with a patent, for example, a patent associated with a particular display may be associated with either a phone model xx001 or a phone model xx 002. Assuming that there are a plurality of goods associated with the patent, if each piece of goods information is to be confirmed to find the target goods, a lot of time is wasted. Therefore, the fifth operable item 242 is provided in the product detail information interface, and operating (e.g. clicking) the fifth operable item 242 can query the product detail information in the product detail information interface, that is, the specific product information, so that the user can conveniently and quickly obtain the information of the target specific product from the plurality of specific products.
M645: and displaying a sixth operable item, wherein the sixth operable item is used for editing the commodity detail information of at least one commodity associated with the selected patent.
The item detail information may include an item specific name, a reference license rate, a company to which the item belongs, a time to market the item, or a remark. After creating a particular item, the user may also need to modify the information of the particular item. Based on the demand, the item detail information interface may be provided with a sixth operable item 243, and operating (e.g., clicking) on the sixth operable item 243 may edit the item detail information. For example, after clicking the sixth operable item 243, an edit item detail information interface may be popped up for editing by the user, and after the user finishes editing, the edit item detail information interface is closed, and the item detail information of the item detail information interface is updated to the edited item detail information. For example, after clicking the sixth operable item 243, the state of the product detail information interface is changed from non-editable to editable, and the product detail information can be directly modified at the product detail interface. Or, the sixth operable item 243 is not needed, the commodity detail information of the commodity detail information interface is directly selected, the selected or activated commodity detail information is changed into an editable state, the user can directly modify, and then the user automatically updates and saves the commodity detail information after clicking other positions by the mouse.
As described above, after entering the patent details interface, the product selection area 22 of the patent details interface may display a product list, where the product list may be fixedly displayed in a specific area, may be suspended in the patent details interface, or may be pop-up displayed by clicking or moving the mouse to another specific area by the user. The user may select one or more items in the list of items to associate with the patent, see, for example, the following steps after M600:
m700: and receiving a fourth instruction, wherein the fourth instruction is used for establishing association between at least one commodity in the commodity list and the selected patent.
M800: in response to the fourth instruction, at least one commodity is associated with the selected patent.
After entering the patent detail interface of a certain patent, the enterprise or the individual can click on a certain commodity or certain commodities in the commodity selection area, and at the moment, the client receives a fourth instruction and associates the patent with the selected commodity in response to the fourth instruction. When the data of the intellectual property system is stored in the server, the client receives the fourth instruction and then sends the fourth instruction to the server. The server may associate the patent with the selected commodity in the database in response to the fourth instruction.
After the patent is associated with at least one commodity, the user can obtain or browse information of the commodity associated with the patent, such as commodity category information, commodity architecture information or business data information, through the patent detail interface after entering the patent detail interface of the patent. See, in particular, the following steps after M800:
m900: and receiving a fifth instruction for displaying commercial data of the commodity, wherein the commercial data comprises at least one of sales time, sales amount, sales profits, patent licensing fees and patent evaluation values.
M1000: in response to the fifth instruction, the business data is displayed.
After entering the patent details interface of a patent, an enterprise or individual may click on an operable item to view business data information for the patent-associated merchandise. After receiving the fifth instruction generated by clicking the enterprise or the person, the client displays the business data of the commodity in response to the fifth instruction. When the data of the intellectual property system is stored in the server, the client receives the fifth instruction and then sends the fifth instruction to the server. The server may obtain the commercial data of the good from the database and send the commercial data to the client in response to the fifth instruction, so that the client may display the commercial data in a chart or list or other manner on an interface displaying the commercial data.
Sales amount, sales profits, patent licensing fees, and patent evaluation values can all be used as the basis for representing the intellectual property related conditions of the commodity. In some embodiments, the intellectual property related status of the commodity may be embodied in a patent licensing fee, which may be derived using the product of the licensing rate and sales of the commodity. In other embodiments, the intellectual property related status of the commodity may be embodied in a patent valuation value. The patent evaluation value can be the commodity value obtained by evaluating the commodity/work by the intellectual property related personnel, for example, the litigation amount or the license fee generated by the commodity/work in actual conditions, or other data which can assist in evaluating the commercial value of the commodity/work, or the patent evaluation value which is set after the intellectual property related personnel evaluates the technology, compares the commodity with other commodities and references the potential value of the commodity-related patent.
For example, as shown in fig. 12, after entering the patent detail interface, the user clicks on one of the other several operable items described in the step M610, and may enter a page displaying the commercial data of the commodity, or directly display the commercial data of the commodity in the patent detail interface.
The association of a commodity with a patent in this application is not simply a matter of informing an enterprise or individual that a patent is being applied for protection of a commodity/work. The method and the device can acquire the commodity category or specific commodity associated with the patent through the patent detail interface, and can acquire the commercial data of the commodity associated with the patent. The commercial data can display the sales amount, sales profits and/or patent licensing fees of the commodity at a certain sales time or sales time period, or the change curves of the numerical values, so that the value of the commodity generated by the patent application can be intuitively obtained, and further, the direction and analysis basis can be provided for the patent application.
Wherein, the business data can be in units of years, for example, the sales amount of the commodity in 2022 is 100 ten thousand yuan, the sales profit is 20 ten thousand yuan, and the patent licensing fee is 5 ten thousand yuan; the sales amount of the commodity in 2021 is 200 ten thousand yuan, the sales profit is 40 ten thousand yuan, and the patent licensing fee is 10 ten thousand yuan. Or the business data may be in units of months, and the business data may show sales amount, sales profits, or patent licensing fees of the goods for each month of a certain year.
Alternatively, the displayed business data may be displayed in a chart form, facilitating the business or individual to visually obtain business data for the goods associated with the patent. Business data may be presented from multiple dimensions, and various embodiments are provided herein. The first may be to display business data for each sales time based on sales time as a reference. See for details the following steps included in M1000:
M1010: and displaying business data on the same interface for displaying a plurality of operable items, wherein the business data takes the sales time as a first coordinate, and takes at least one of sales amount, sales profits, patent licensing fees and patent evaluation values as a second coordinate for graphic display.
By selecting one of the other of the plurality of operable items, a chart of business data may be displayed on the same interface on which the plurality of operable items are displayed. The relationship between the commodity and at least one of sales amount, sales profit, patent licensing fee, and patent evaluation value at each sales time can be intuitively obtained from the chart.
The second embodiment may be based on commodity sales areas, and show business data of each sales area, and may refer to the following steps included in M1000:
m1020: and displaying business data on the same interface for displaying a plurality of operable items, wherein the business data takes a commodity sales area as a first coordinate, and takes at least one of sales amount, sales profits, patent licensing fees and patent evaluation values as a second coordinate for graphic display.
Alternatively, since the form of the chart may be various, such as a bar chart, a pie chart, a line chart, a graph, etc., a seventh operable item may be provided at the interface for displaying the business data to adjust the display style of the chart.
Optionally, the area for performing the graphic display may display, in addition to the commercial data of the commodity associated with the patent, a comparison chart of the commercial data of the commodity associated with the patent and a commodity in the commodity list, and specifically, the following steps included in M1000 may be referred to as follows:
m1030: and receiving a seventh instruction, wherein the seventh instruction is used for selecting a comparison commodity in the commodity list so as to compare the commercial data of the comparison commodity with the commercial data of at least one commodity associated with the selected patent.
M1040: and responding to the seventh instruction, and displaying the business data of the comparison commodity and the business data of at least one commodity associated with the selected patent in the same graph.
After the enterprise or the person selects the comparison commodity and enters the comparison portal, the client side can receive a seventh instruction, and respond to the seventh instruction to display the business data of the comparison commodity and the business data of at least one commodity associated with the selected patent in the same graph. When the data of the intellectual property system is stored in the server, the client receives the seventh instruction and then sends the seventh instruction to the server. The server responds to the seventh instruction, can obtain the commercial data of the comparison commodity, and send the commercial data of the comparison commodity to the client so that the client can display the commercial data of the comparison commodity and the commercial data of at least one commodity associated with the selected patent in the same graph.
The interface displayed in the graph may be provided with entries for comparison, such as buttons. Through the portal, the commodity associated with the patent can be selected to be compared with the commercial data of a certain commodity in the commodity list. The sales profits of the two commodities may be set to be compared by default. Enterprises or individuals may also choose bases for comparison, such as patent licensing fees, patent valuations, and the like.
Of course, alternatively, step M900 may be omitted, and the business data may be displayed directly by step M800.
The first embodiment of the above related method of associating a commodity with a patent may be implemented on the basis that data (including system page presentation and page presentation data, etc.) related to an intellectual property system is stored in a storage medium of a client terminal. The present application also provides embodiments in which clients interact with servers, in which the aforementioned data may be stored in the servers, by which the clients interact to obtain data for the design of the intellectual property system. See in particular the following for a second embodiment of the method of associating goods with patents.
As shown in fig. 13, a second embodiment of a method for associating an article with a patent of the present application may use a client as an execution body, including the following steps: g100: receiving a first instruction, and sending the first instruction to a server, wherein the first instruction is used for entering a project interface of an intellectual property system, and the project interface displays at least one patent; g200: receiving a second instruction and sending the second instruction to a server, wherein the second instruction is used for selecting commodities in a commodity list or selecting patents; g300: receiving a third instruction and sending the third instruction to a server, wherein the third instruction is used for establishing association between the selected commodity and the selected patent; g400: and receiving a fourth instruction and transmitting the fourth instruction to the server, wherein the fourth instruction is used for displaying or editing commercial data of the commodity, and the commercial data comprises at least one of sales time, sales amount, sales profit, patent licensing fee and patent evaluation value.
In the intellectual property industry, industry personnel typically conduct patent surveys in units of items. For example, industry personnel need to conduct patent surveys on the water dispenser. The items may include an analysis report generated by a patent investigation of the water dispenser, a patent document for generating an analysis report reference, and the like. Embodiments of the present application provide an intellectual property system for patent analysis. Each item in the intellectual property system may be provided with a corresponding item interface that displays at least one patent. Optionally, at least one analysis report may also be displayed in the project interface.
Sales amount, sales profits, patent/copyright licensing/royalties, and patent evaluation values can all be used as bases for representing intellectual property related conditions of goods/works.
Through associating the commodity with the patent at the project interface, the user can obtain the business data of the commodity associated with the patent when viewing the patent, so that the user can directly obtain the intellectual property related condition of the commodity/work, the development of intellectual property analysis projects and the management and operation of the existing intellectual property can be promoted by using the intellectual property system by the intellectual property manager of the enterprise, and meanwhile, the validity and the necessity of the intellectual property management work can be conveniently described to the related personnel.
At the beginning of intellectual property acquisition, most of the intellectual property acquisition cannot be obtained by side knowledge of the value through legal means such as litigation or directly through transactions. Because litigation or trading can occur, or even not occur, when a commodity/work is sold/used over a period of time, such as years. Therefore, the evaluation and presentation of the value of intellectual property have been an unresolved problem in the industry. This problem directly results in the intellectual property applicant/registrant being enthusiastically charged with costs to obtain a pile of intellectual property after manpower and material resources, but does not know how much value or effect is. Furthermore, on the premise that the value of the intellectual property rights cannot be objectively and comprehensively considered, the intellectual property rights of enterprises can be ignored and even unnecessarily plagued and blocked. On the other hand, enterprises cannot effectively use intellectual property as a sharps and rely on negotiations, transactions and decisions during business operations, resulting in inefficiency and loss of business operations.
The embodiment of the application provides an intuitive and effective method for associating or displaying the intellectual property and the business data by means of the intellectual property system, and the business data can be easily obtained in the early stage of the intellectual property generation because the business data comprises at least one of the sales time of commodities, sales amount, sales profits, patent licensing fees and patent evaluation value; meanwhile, the correlation or display of the intellectual property and the business data is based on the intellectual property system, and the intellectual property system is used for analyzing and managing the intellectual property, so that the intellectual property analysis and management and the correlation display of the business data can be combined, the value content of the intellectual property analysis and management is improved, and the development of the intellectual property work is promoted.
Alternatively, the business data in the present embodiment may be graphically displayed with the sales time as the first coordinate and with at least one of the sales amount, sales profit, patent licensing fee, and patent evaluation value as the second coordinate; or the commercial data is graphically displayed with the commodity sales area as a first coordinate and with at least one of sales amount, sales profit, patent licensing fee, and patent evaluation value as a second coordinate.
Optionally, the graph of the business data in the embodiment may also be adjusted in style, and may be downloaded, and may also be sent to the shared person in a link form, where the shared person may enter the graph interface for displaying the business data through the link, or directly share the graph in a graph form to the shared person, and the shared person may directly view the graph of the business data shared by the shared person.
Optionally, other commodities in the commodity list can be selected to view the commercial data of other commodities in the commodity list, or the commercial data of the commodity or a part of other commodities can be selected to compare the commercial data of the commodity with the commercial data of the comparison commodity. Thus, the user can know the intellectual property related conditions of the commodities more deeply.
As shown in fig. 14, a third embodiment of a method for associating a commodity with a patent of the present application may use a server as an execution body, and includes the following steps: h100: the server receives the first instruction and responds to the first instruction to generate the content of a project interface of the intellectual property system, and the project interface displays at least one patent; h200: sending the content of the project interface to the client; h300: the server receives a second instruction generated based on the project interface and responds to the second instruction to select the commodity in the commodity list or select the patent; h400: the server receives a third instruction and responds to the third instruction to establish association between the selected commodity and the selected patent; h500: the server receives the fourth instruction and transmits commercial data of the commodity to the client in response to the fourth instruction, the commercial data including sales time, and at least one of sales amount, sales profits, patent licensing fees, patent evaluation values, or edits the commercial data.
