In this sense, you accept that it is beyond our power to restrict such access and guarantee the security of your files. You are completely in charge of protecting your data on our servers, which suggests that you would better consider carefully any piece of information before uploading it to your newly allocated server space. It is recommendable to avoid publishing personal data that could be abused online. The order form completion represents the electronic signing of this document.
ENTIRE AGREEMENT; SEVERABILITY OF AGREEMENT
We shall provide our Services to you (the Customer) under the Terms and conditions of this Customer Agreement. The Agreement is intended to keep the integrity of both parties and to protect both parties from liability. This Service Agreement will be enforced to ensure the speed, power, performance, and reliability of our services. Along with the Order Form and any other documents or agreements explicitly specified in this Agreement, the Customer Agreement constitutes the whole act of convention between us and the Customer, thus being the most significant document of the newly-established relationship. In case that a court of competent jurisdiction considers that any of the Agreement's provisions is invalid, unenforceable, or void, the remaining ones will completely reserve their validity. Customer's side of the Agreement could be presented by the following parties: an individual with personal demands, being over 18 years of age; a legal entity such as a corporation, a limited liability company etc. that is consistent with state's law system. If a person represents the Customer for some reason, he/she should be legally authorized to act in his/her name, thus accepting, executing and delivering the Agreement. You understand and agree that the Service is provided "AS-IS" and that we assume no responsibility for the timeliness, deletion, failure to deliver or store any Customer communication or personalization settings. Customer Support – All customer support is provided via our online help desk located within our client area, we aim to respond to all requests within 24 hours. Complaints Procedure – You can read our full complaints procedure here. Please note that Consumers are eligible for a 14-day cooling off period for non-bespoke products. Bespoke products are anything that has been customised to the customer, such as domain names. As such, they cannot be sold and are non-refundable. Please note that the Cooling Off period only applies to Consumers, not Business Customers.
1. USER OBLIGATIONS
You represent and warrant that: Your content does not and shall not contain any content, materials, data, work, trade or service mark, trade name, link, advertising or services that actually or potentially violate any applicable law or regulation or infringe or misappropriate any proprietary, intellectual property, contract or tort right of any person and that You own Your account content and all proprietary or intellectual property rights therein, or have express written authorization from the owner to copy, use and display the content on and within Your server account. You also represent and warrant that the server content being hosted shall not be used in connection with any illegal activity.
You expressly (i) grant to Us a license to cache the entirety of the content that is submitted, stored, distributed or disseminated by you via the Services and your website, including content supplied by third parties, hosted under this agreement; and (ii) agree that such caching is not an infringement on any of your intellectual property rights or any third party's intellectual property rights.
2. PROHIBITED CONTENT & ACTIVITIES
You agree not to use Our services to host, store, distribute, or engage in any content or activities that are illegal, harmful, or offensive. This includes, but is not limited to:
Nudity and Pornographic Content: Any content containing nudity, pornographic material, or sexually explicit content is strictly prohibited.
Hate Speech and Discrimination: Content that promotes hate, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
Illegal Activities: Content or activities that promote, encourage, or facilitate illegal activities, such as copyright infringement, hacking, fraud, or drug trafficking.
Violent and Extremist Content: Content that depicts, glorifies, or encourages violence, cruelty, or extreme acts.
Malicious and Harmful Content: Content that contains malware, viruses, spyware, or any other malicious code.
Harassment and Cyberbullying: Content that targets, harasses, bullies, or defames individuals or organizations.
Child Exploitation: Any content related to the exploitation or sexualization of minors is strictly prohibited and will be reported to the appropriate authorities.
Intellectual Property Infringement: Hosting or distributing any content that infringes on the copyrights, trademarks, or other proprietary rights of any third party.
Warez, Cracks, and Pirated Content: Distributing or hosting warez, cracks, pirated software, or any other content intended to circumvent intellectual property rights.
Proxy Services and Traffic Relaying: Operating any kind of proxy server, traffic relaying program, or using the service as a VPN for traffic tunnelling.
Malicious Activities: Engaging in actions that cause harm to Us or other customers, such as getting our IP addresses blacklisted or launching DDoS attacks.
Unacceptable Content: Uploading or hosting IRC bots, file storage services, mirror/banner-ad services, topsites, streaming services, Escrow, High-Yield Interest Programs (HYIP), investment sites (e.g., FOREX, E-Gold Exchange), bitcoin miners, sale of controlled substances without a permit, AutoSurf sites, Bank Debentures, lottery sites, muds/RPGs, hate sites, hacking-focused sites, IP Scanners, Brute Force Programs, Mail Bombers, and Spam Scripts.
We reserve the right to determine, at Our sole discretion, whether content or activities violate this policy. If prohibited content or activities are detected, We may take appropriate action, including but not limited to account suspension, termination, or reporting to relevant authorities, without prior notice or refund.
3. RESOURCE USAGE
3.1. General Limitations
In your use of the Shared Hosting Services, you may not:
- Use more than 10% of our platform's processing capacity. Our resource limits (enforced by CloudLinux LVE) are designed for typical website usage and are not intended for sustained, high-intensity processes. Consistent usage at or near your account's maximum allocated limits may result in suspension or termination.
- Run stand-alone, unattended server-side processes or any daemons (e.g., IRCd).
- Run any type of web spider or indexer.
- Run any software that interfaces with an Internet Relay Chat (IRC) network.
- Run any bit torrent application, tracker, or client.
- Participate in any file-sharing/peer-to-peer activities.
- Run any gaming servers.
- Run cron jobs that cause a disproportionate load on the server. While cron jobs can be scheduled to run frequently, they must be optimized to be efficient. Any cron job that consistently uses excessive server resources (such as CPU, memory, or I/O) may be disabled by our team, and we reserve the right to suspend accounts that repeatedly run resource-intensive cron jobs.
- Give away web space under a domain.
- Operate a proxy website or service.
- Act as a remote file host for other websites.
- Operate self-hosted file sync or "cloud storage" services (e.g., OwnCloud, Pydio).
- Run any news or blog websites that generate content automatically using bots.
3.2. Disk Usage & Storage
Overall Disk Space and Inode Limits:
The following limits apply per individual account:
- Shared Hosting (non-premium plans): Limited to 50GB disk space and 500,000 inodes
- Standard Reseller Accounts: Limited to 50GB disk space and 500,000 inodes per end-user account
- Premium Reseller Accounts: Limited to 100GB disk space and 1,000,000 inodes per end-user account
- Premium/Managed Hosting (non-reseller): Limited to 300GB disk space and 3,000,000 inodes
For reseller accounts, these limits apply to each individual end-user account created under the reseller, not as an overall limit for the reseller account itself. The overall limit for any account, including resellers, is capped at 10% of the server's total resources.
File Type and Usage Restrictions:
The following restrictions apply to all account types unless otherwise specified:
- Backup Facility: You must not use the Hosting Services as a backup or file-sharing facility. All files must be web-visible and part of an active website.
- Multimedia Files: A maximum of 5GB can be used for music, video, or other multimedia files (e.g., .aac, .avi, .mp3, .mp4, .mpeg, .jpg, .png, .gif).
- Archives: A maximum of 1GB can be used for archives and disk images.
- Databases: A maximum of 1GB can be used for databases and database dumps (e.g., .sql files).
- Executables: A maximum of 1GB can be used for executable files.
- File Removal: We reserve the right to remove certain file types (e.g., mp3, mp4, tar.gz, zip, .wpress, .jpa, .exe, wav) without warning to maintain server stability.
- MySQL Databases: Individual databases are limited to 1024MB in size at our discretion.
For Premium/Managed Hosting accounts, the multimedia, archives, databases, and executables limits may be adjusted at our discretion based on legitimate usage requirements.
3.3. Specific Terms for Resellers
As a reseller, you are bound by all terms in this agreement. In addition:
- You must not resell our services unless you have purchased a specific reseller product.
- You are responsible for the good housekeeping of the services offered to you, including monitoring and deleting accounts or files that violate our terms.
- We may terminate a reseller account without warning for repeated breaches of these terms.
- Reseller accounts are limited to the number of end-user accounts specified in your plan.
- We will impose limits if your usage is deemed excessive or consumes more than 10% of the server's overall resources.
4. BACKUP POLICY
4.1. Backup Exclusions
Any hosting account may be excluded from our weekly or daily backups if it meets any of the following criteria:
Shared Hosting Accounts (non-premium plans):
- Uses more than 50GB of disk space
- Contains more than 500,000 inodes
- Is currently suspended
- Takes longer than 1 hour to complete its backup process
Standard Reseller Accounts:
- Uses more than 50GB of disk space
- Contains more than 500,000 inodes
- Is currently suspended
- Takes longer than 1 hour to complete its backup process
Premium Reseller Accounts:
- Uses more than 100GB of disk space
- Contains more than 1,000,000 inodes
- Is currently suspended
- Takes longer than 1 hour to complete its backup process
Premium/Managed Hosting Accounts (non-reseller):
- Uses more than 300GB of disk space
- Contains more than 3,000,000 inodes
- Is currently suspended
- Takes longer than 1 hour to complete its backup process
Users whose accounts are excluded from backups are solely responsible for maintaining their own backups.
4.2. Backup Storage & Process
Our backup service is a courtesy. We cannot be held responsible for missing or corrupt backup data. It is always advisable to maintain your own off-site backups.
Storing your own backups (e.g., from Softaculous or backup plugins) on your hosting account is strictly prohibited. Backups must be stored 'offsite' with a cloud provider.
Files and extensions that are excluded from our backups can be amended at any time at our sole discretion.
Our standard backup schedule is typically 7 daily backups retained for 28 days, but this can vary.
When an account is terminated, we may hold a backup for a maximum of 48 hours.
Restoring an account after cancellation, closure, or non-payment will incur additional administrative charges, the costs of which may vary depending on the size and resource demand as part of restoration.
4.3. VPS Backup Policy
VPS (Virtual Private Server) accounts are not included in our automatic backup schedules. Any backups taken of VPS servers are done at our sole discretion for infrastructure redundancy purposes only and cannot and will not be guaranteed or made available for restoration as part of the service.
VPS backups are not inclusive of the VPS service. Any restoration requests for VPS servers may be chargeable depending on the complexity and resources required.
It is imperative that all VPS clients maintain their own off-site backup solution in all cases. You are solely responsible for implementing and managing your own backup strategy for VPS services.
5. EMAIL & ANTI-SPAM POLICY
You must comply with the CAN-SPAM Act of 2003 and all applicable anti-spam legislation. Sending mass unsolicited email (SPAM) is prohibited.
5.1. Prohibited Email Activities
- Using our network to receive replies to SPAM.
- Forging email headers ("spoofing").
- Using third-party proxies or mailing software for spamming.
- Configuring a mail server to relay third-party emails without authentication.
- Hosting web pages advertised via SPAM ("spamvertising").
- Using APIs to bulk-generate mailboxes.
- Using weblogs, chat rooms, guestbooks, etc., to transmit unsolicited bulk messages.
5.2. Email Sending & Storage Limits
- Sending Limits: Email sending limits are defined in your service documentation and must be adhered to at all times.
- Mailboxes: A single domain may not host more than 100 mailboxes.
- Storage: Total email storage per individual account shall not exceed 20GB.
- Connections:
- POP3: Up to 10 concurrent connections per IP.
- IMAP: Up to 30 concurrent connections per IP.
5.3. SPAM Enforcement
If we determine you have deliberately or recklessly sent SPAM, we reserve the right to:
- Assess a significant financial charge to your account to cover administration costs.
- Share your details with anti-SPAM organisations.
- Immediately suspend or terminate your account.
6. VPS (VIRTUAL PRIVATE SERVER) POLICIES
6.1. Fair Usage
Traffic (Bandwidth): Your monthly traffic is limited based on your VPS plan. Overage is not permitted; your account will be suspended until the next month if you exceed your limit.
Disk Space: Your disk space is limited based on your VPS plan. Note that system files may occupy a portion of your allocated storage.
Backups: VPS servers are not included in our automatic backup schedules. You are solely responsible for implementing and maintaining your own off-site backup solution. See Section 4.3 for full details.
6.2. Management Tiers
Unmanaged: No assistance with software or server management is included.
Managed: Includes a specified amount of technical assistance per month. Ideal for those who can handle day-to-day operations but need occasional help.
Fully Managed / Monitored: Includes extended technical assistance per month and proactive server monitoring.
The specific amount of assistance time included is defined in your service plan documentation.
7. SUPPORT SERVICES
7.1. Fair Use of Support
Our support services are provided to assist with issues directly related to the hosting platform and its availability. While we strive to be as helpful as possible, our support does not extend to website development, code debugging, third-party application issues, or other tasks outside the scope of our direct service management.
We reserve the right to limit support interactions if they are deemed excessive or fall outside this fair use policy. Please refer to our support documentation for a detailed breakdown of what is included with your specific service plan.
8. DOMAIN NAMES
Nominet: All .uk domain name registrations are bound by Nominet's terms of service, to read these in full please see Nominet Terms of Service.
Renewals: All domains are auto-renewed on the term they were originally ordered, e.g. 1-10 years, we will send out reminder emails 60 days, 30 days, 14 days, 7 days and 1 day before expiry. We will send the emails to the email address on the account, it is the registrants responsibility to make sure their contact details are up to date. We take no responsibility if your domain renewal fails due to your contact details being incorrect. If you do not wish to renew a domain please make sure you contact us a minimum of 14 days before your domain expires by contacting support via the client area. All domain renewals will be billed and auto renewed on their date of expiry unless cancelled or auto renewal is disabled (This can be done via the Domains section of the client area).
Expiry: If you do not renew your domain before its expiry date it will have all services we provide suspended and you will have up to 30 days (protected period) after to renew the domain name at the original renewal fee. Please see our domain names page for renewal fees. After 30 days your domain will be suspended and will go into a 60 day grace period which you can still renew your domain name but with an additional redemption fee, this fee varies with domain TLD, please contact support for the exact price. This must be requested via our client area before the 80th day after your domain has expired, after 90 days your domain will be cancelled and deleted from the register and made available for resale through a third party registrar. We will not guarantee the renewal of a domain name.
Please note that some international domain names must be renewed X days before expiry or they will drop straight into redemption, the table below shows domain TLDs and the number of days they must be renewed before expiry.

Domain Contact Info / Whois: When a domain name is registered / renewed the whois contact information must be validated by the main contact, failure to do this could result in the domain name registration being cancelled without refund. The Client accepts and consents to us making the Client's registration details in relation to the Domain available to third parties including ICANN and the applicable registry for the Domain as applicable including to law enforcement and governmental bodies as required by law.
Domain Transfers: If you wish to transfer your domain name to another registrar you can do so without charge / penalty via the Client Area. Please note that non .uk domains that have been registered or renewed in the last 60 days cannot be transferred. Domain transfers are free, but for certain TLDs 1 years renewal is added to the domain name's existing renewal date, therefore the rate of one years domain renewal is charged for a successful transfer or said TLDs.
9. SSL CERTIFICATES
Renewals: All SSL certificates are auto-renewed on the term they were originally ordered, e.g. 1-10 years, we will send out reminder emails 14 days before expiry. We will send the emails to the email address on the account, it is the registrants responsibility to make sure their contact details are up to date. We take no responsibility if your SSL certificate renewal fails due to your contact details being incorrect. If you do not wish to renew a SSL certificate please make sure you contact us a minimum of 14 days before your SSL certificate expires by contacting support via the client area. Unless auto renewal is disabled (This can be done via the services section of the client area) SSL certificate renewals will be auto renewed on their date of expiry, or if the client makes payment prior to expiry it is renewed at that point in time.
Modifications: Once an SSL certificate has been issued no changes can be made to it until renewal time. Any changes must be requested prior to renewal.
Refunds: Once an SSL certificate has been issued, either as a new order or renewal it cannot be cancelled or refunded, if a SSL certificate is no longer required then auto-renewal must be disabled a minimum of 14 days prior to expiry via the Services section of the client area (Click here to access the services section of the client area)
10. SERVICE GUARANTEES
We will guarantee 99.9% network uptime, not including time whilst servers are being restarted, or hardware breakdowns. We will pro-rate credits for uptime below 99.9% upon request. This, however, does not refer to problems stemming from:
- Server Hardware Breakdown
- User error(s) or purposeful interruption(s) of the user service (e.g. if the client shuts his/her own server down, we are not responsible for the downtime)
- Failures due to software that is not explicitly supported by us.
Consequently, if a hardware crash provoked by the customer happens, we are beyond the control and responsibility for the resulting downtime.
11. PAYMENT, CHARGEBACKS AND RETURNED CHECKS
1. Monthly terms, domain registrations, renewals and the website builder service are not included in the money back guarantee. The money back guarantee period starts from the activation date of the first service ordered. If a free domain was included with a service the cost of this will be deducted from any refund. Any additional service fees waived during the initial purchase, such as (but not limited to) free migrations, dedicated ip addresses, SSL Certificates will be deducted from the refund at their standard rate.
2. We will charge customers with fees based on the fee structure at the time of the sign-up process. We reserve the right to introduce changes to the packages when needed regarding price and set of features. This means that the current price list on the site may differ from the pricing and features of the customer's account.
3. When signing up for an account with us, the customer agrees to pay for the period of one month (30 days) or 1 year depending on the account type. We grant customers with 48 hours over the official payment period. In case that the payment has not been received, the account will be suspended. Chargebacks are not considered as a way of refunding. Any customer who provides a credit card chargeback in response to a bill or order placed will be subject to collections and legal action. He/she will be charged £30.00, when signing up, customers accept these terms and conditions, thus agreeing to observe them strictly.
12. PAYMENT TERMS
All invoices have payment terms of 14 days, any account that remains unpaid after this time will be suspended, after 1 month of non payment the account and all items relating to the account removed from our systems, this includes account backups.
13. GENERAL TERMS
13.1. Accounts & Security
You are responsible for all activity on your account and for maintaining the confidentiality of your password. You bear the full risk of loss and damage to your content. Our services are not intended for data archiving, and you are responsible for maintaining your own independent backups.
In the event of account suspension or termination due to a breach of this policy, access to all account data may be immediately revoked. It is Your sole responsibility to maintain regular off-site backups and to have secured any necessary data before any violation occurs. We will not be liable for any data loss resulting from suspension or termination.
You will receive an account designation upon completing the registration process of the Service. You are responsible for maintaining the confidentiality of your password and account, and you are fully responsible for all activities that occur under your password or account. You agree to:
- immediately notify us about any unauthorized use of your password or account or any other breach of security
- ensure that you exit from your account at the end of each session.
We cannot and will not be liable for any loss or damage arising from your failure to comply with this.
13.2. Network & Downtime
We will use our best efforts to maintain a full-time Internet presence for your account. However, we are not liable for any damages resulting from network downtime due to utility interruption, equipment failure, natural disaster, or human error. Our total liability shall not exceed the amount paid by you within a given month.
13.3. Third-Party Software
We may provide third-party software (e.g., cPanel, Softaculous) on an "as is" basis. We are not responsible for any faults or damages caused by this software. You are responsible for any licensing fees required.
13.4. Reservation of Rights
We reserve the right to refuse service to anyone and to suspend or terminate accounts for any activity we deem harmful to our customers, operations, or reputation. This includes, but is not limited to, non-payment, illegal activities, harassment, and violations of this policy.
We expressly reserve the right to deny, cancel, terminate, suspend, lock, or modify access to (or control of) any Account or Services (including the right to cancel or transfer any domain name registration) for any reason (as determined in our sole and absolute discretion), including but not limited to the following: (i) to correct mistakes made in offering or delivering any Services (including any domain name registration), (ii) to protect the integrity and stability of, and correct mistakes made by, any domain name registry, (iii) to assist with our fraud and abuse detection and prevention efforts, (iv) to comply with court orders against you and/or your domain name or website and applicable local, state, national and international laws, rules and regulations, (v) to comply with requests of law enforcement, including subpoena requests, (vi) to comply with any dispute resolution process, (vii) to defend any legal action or threatened legal action without consideration for whether such legal action or threatened legal action is eventually determined to be with or without merit, or (viii) to avoid any civil or criminal liability on the part of us, our officers, directors, employees and agents, as well as our affiliates, including, but not limited to, instances where you have sued or threatened to sue us.
13.5. Limitation of Liability
The services are provided on an "AS IS" basis. We expressly disclaim all warranties. We are not liable for any loss of data, interruption of business, or other damages arising from the use of our services.
We shall not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data and earnings resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.
13.6. Legal Age
You attest that you are of legal age (18 or over) to enter into this Agreement.
14. SECURITY VIOLATIONS
Any Customer in violation of system or network security is subject to criminal and civil liability, as well as immediate account termination. Examples include, but are not limited to the following:
- Unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic.
- Interference with service to any user, host or network including, without limitation, e-mail bombing, flooding deliberate attempts to overload a system and broadcast attacks.
- Forging of any TCP/IP packet header or any part of the header information in an e-mail or newsgroup posting.
Harm to Our Servers: Any attempts for doing harm to a server or customer are explicitly banned. We will immediately and resolutely react to any attempt of use of an Internet account or computer by a customer unauthorized by the account or computer owner. Such attempts include "Internet scamming" (tricking other people into releasing their passwords and etc.), password robbery, security hole scanning etc. It DOES NOT matter whether the attacked account or computer belongs or not to our Services, the fraud will be subject to actions based on the very nature of the attack which could be a warning, an account suspension or cancellation and civil or criminal legal action.
15. YOUR RESPONSIBILITIES
You are solely responsible for the content of your messages. Using the Service in connection with surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages (commercial or otherwise) is prohibited. In consideration of your use of the Service, you agree to:
1. Provide true, accurate, current and complete information about yourself as prompted by the registration form of the Service.
2. Maintain and promptly inform us to update Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
3. When signing up for an account, each customer agrees to submit correct and up-to-date contact details, meaning that when introducing any changes to this information, he/she is obliged to notify us in the course of a 10-business-day period after the changes become valid. The introduction of changes should be done online through customer's Control Panel, not via e-mail. This requirement is also in force – customers will always be aware of any contact information changes that the company places within its website. This way, a flawless communication process between both sides is guaranteed.
4. Customer agrees not to publish on or over its account any information, software or other content, which violates or infringes upon the rights of any others or which knowingly contravenes the laws of any jurisdiction in which such content is generally accessible.
16. CUSTOMER WEBSITE; E-COMMERCE; CUSTOMER WARRANTIES
1. When buying an allocated space on our servers, customers agree to be fully responsible for the development, operation and maintenance of their web site, online store and e-commerce activities within that space. Each customer is in charge of all the products and services as well as of all contents and materials appearing online, including:
- the accuracy and relevance of Customer Content and content and material showcased in its store or on its products
- certainty that the Customer Content and content and materials appearing in its store or on its products do not violate or infringe upon the rights of any person
- certainty that the Customer Content and the content and materials appearing in his/her store or on his/her products are not calumnious or somehow illegal.
Customer is the only one in charge of approving, processing and filling customer orders and of taking care of customer requests or complaints. Customer is the one in charge of the payment or satisfaction of any and all taxes related to his/her web site and online store.
2. Customer bears the responsibility for ensuring the security and confidentiality of any customer data (including, without limitation, customer credit card numbers) that he/she may receive in connection with his/her web site or online store.
3. Each Customer guarantees that he/she owns or possesses the right to use the Customer Content and its material, including all text, graphics, sound, music, video, programming, scripts and applets. Each Customer warrants that the use, reproduction, propagation and transmission of the Customer Content and any information and materials contained inside do not, and will not:
- infringe or abuse any copyright, patent, trademark, trade secret or any other proprietary right of a third party
- break any criminal laws or manifest false advertising, unfair competition, vilification, privacy intrusion; violate a right of publicity or violate any other law or regulation.
Each Customer empowers us to reproduce, copy, use and propagate all and any part of the Customer Content for ensuring and operating the Services. We are granted the right to assess the extent these operations need to be done.
17. TORTIOUS CONDUCT
Any case of indecent treatment towards our employees will be considered inappropriate. Each Customer is anticipated to conduct a professionally mannered communication with our employees regarding any requests for help through e-mail or by means of the Ticket Desk Support System. Each Customer should avoid applying any forms of written emotional outburst or cursing. Any attempts of deliberately undermining behavior will be interpreted as a breach of this TOS.
Other acts of treatment towards our employees that will be considered as unacceptable include any verbal, oral, written or delivered by a second party threats addressing us or any of our employees, partners, equipment, and concerns. Any forms of such threats will be interpreted as a breach of this TOS. We keep the right to assess which behaviour will be treated as a breach of this TOS and to give no refunds to the users whose accounts have been suspended for violating the aforementioned rules.
18. COPYRIGHTS
Copyrighted material must not be placed on Customers' accounts without the permission of the copyright owners or people that are specifically authorized by the copyright owners. Only copyright owners or people specifically authorized by them may upload copyrighted material to the account.
Upon our receipt of a notice of a claimed copyright infringement containing the above information, after confirmation we will promptly remove the allegedly infringing material from the Services and carry out further procedures if necessary. We will assume no liability to any Customer of the Services for the removal of any such material.
If any copyrighted material including Mpeg layer 3 files (MP3) is uploaded onto our servers, the hosting account holding the copyrighted material will be instantly terminated and the customer may be fined up to $3,000 USD.
19. THIRD PARTY
Any dealings with third parties (including advertisers) included within the Services or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. We shall not be responsible or liable for any part of any such dealings or promotions.
20. NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
We reserve the right at all times to disclose any information as we deem necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in our sole discretion.
We are within the capacity to refuse service to unlawful parties. Our servers can be used explicitly for legal purposes only and each attempt for taking indecent advantage of the servers inconsistent with the rules will be immediately rejected. In this light, we expressly forbid any breach of Federal, State or Local regulation, including, but is not limited to the transmission of: copyrighted material, material legally judged to be threatening or obscene and material protected by trade secrets.
Management will thoroughly scrutinize any of the received orders and decide to their own discretion which of them do not comply with the officially stated requirements for use of the company's servers. Our servers CAN NOT be used for the propagation, distribution, housing, processing, storing, or handling in any way of lewd, obscene, adult OR pornographic material, or any other material which is considered impermissible by the company including, but not limited to – pornography, adult materials, satanic materials, and any other materials of an adult nature.
21. FORCE MAJEURE CIRCUMSTANCES
We will be in an off-liability position as regards the failure or delay in doing our professional duties in consequence of circumstances beyond our control. Such circumstances could be provoked by acts of any governmental body, war, rebellion, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for provisioning of the Services.
22. ASSIGNMENT
Customer shall not have the right to assign this Agreement without our written permission. This Agreement shall be in force and effect to the total benefit of Customer and us and their successors and permitted assigns.
This agreement constitutes the whole act of convention between the parties with regard to the agreement signed between them. It is not subject to any amendments, modifications, or any other alterations with the exception of changes introduced through a written instrument that is signed by the party to be charged.
This Agreement shall be interpreted in consistence with the laws of the country of United Kingdom.
This Agreement shall be in force and effect entirely to the benefit of the parties hereto and their respective heirs, executors, administrators, successors and assigns.
The captions and headings contained in this TOS are aimed at facilitating the text comprehension. They are not a part of the very Agreement, and shall not limit or construe the provision they refer to.
This Agreement may be executed in counterparts, which will be considered as original.
23. UNLIMITED / UN-METERED ACCOUNTS
When we say unlimited domains, unlimited disk space and bandwidth, of course there are terms & conditions that you must adhere to. This means unlimited webpages, domains and web graphics within the inode and hardware resources limits of the package, not downloads or streaming media. Our servers are shared hosting servers and memory, CPU and disk usage is not unlimited. CPU intensive files are not permitted on our servers and accounts may not to be used to host a collection of mp3s, audios, videos, anime, .rar files, Warez, gamers sites, shout cast and similar, or to backup your computer or another source. They may not be used for general storage of any type. They may not be used as download mirrors or download/upload portals. While the sale of eBooks and other legal small download files are permitted within reason (see download files below) with the unlimited package, hosting and storage of mass quantities where our servers are used as a distribution point is not permitted.
They may not be used for HYIP (High Yield Investment Programs), Ponzi schemes or pyramid schemes. They may not be used to provide proxy servers. All content stored on a reseller account must be directly used on the Internet by the website associated with that account. These accounts may not be used as a download distribution point for your software or media. They are to be used for standard web practices only. This means that all content stored on an unlimited account must be used for "acceptable" website use. Unacceptable usage is anything that a shared server would not be able to provide under standard circumstances and uses a high percentage of CPU or Memory (10%+) usage. Free hosting is not permitted with any of our packages.
