Terms of Use

Agreement to Terms

These Terms of Use are a legally binding agreement between you ("you") and .fmbot ("we", "us", or "our"), concerning your use of .fmbot and any related services, including our website at fm.bot (collectively, the "Bot").

By using the Bot, you agree to be bound by these Terms. If you do not agree, you must stop using the Bot immediately.

We may update these Terms from time to time. Changes take effect when posted, and continued use of the Bot constitutes acceptance of the updated Terms.

Age Requirement

The Bot is intended for users who are at least 13 years of age. If you are under 13, you may not use the Bot. If you are a minor (generally under 18), you must have your parent or guardian's permission to use the Bot.

User Representations

By using the Bot, you represent that:

  1. You have the legal capacity to agree to these Terms
  2. You are at least 13 years old
  3. If you are a minor, you have parental permission
  4. You will not access the Bot through automated or non-human means
  5. You will not use the Bot for any illegal or unauthorized purpose
  6. Your use will comply with all applicable laws and regulations

Fees and Payment

We use OpenCollective, Discord and Stripe for payments.

Stripe: When you make a purchase through Stripe, you agree to their terms and privacy policy. For Stripe payment issues, contact us on our support server or via email: [email protected]. Only billing-related emails will be answered.

Discord: When you make a purchase through Discord, you agree to their Paid Services Terms. For Discord payment issues, contact Discord billing support.

OpenCollective: When you use OpenCollective, you agree to their Terms of Service and Privacy Policy. For OpenCollective payment issues, contact them directly — .fmbot has limited ability to resolve these.

Prohibited Activities

You may not use the Bot for any purpose other than its intended use. You agree not to:

  • Systematically scrape or extract data from the Bot without written permission
  • Trick, defraud, or mislead us or other users, especially to obtain sensitive account information
  • Attempt to circumvent, disable, or interfere with security features of the Bot
  • Use information obtained from the Bot to harass, abuse, or harm others
  • Abuse our support services or submit false reports
  • Use the Bot in violation of any applicable laws
  • Send viruses, spam, or other material that interferes with the Bot's operation
  • Use automated tools (scripts, bots, data miners) to interact with the Bot
  • Interfere with or create an undue burden on the Bot's infrastructure
  • Harass or threaten our team members
  • Attempt to bypass access restrictions
  • Use the Bot for unauthorized advertising
  • Violate Discord's Terms of Service
  • Violate Last.fm's Terms of Use
  • Violate Spotify's Terms of Use

Contributions and Feedback

By submitting suggestions, feedback, or other ideas about the Bot, you agree that we may use and share such feedback for any purpose without compensation to you.

You retain ownership of any contributions you make. We are not liable for statements in your contributions, and you agree to hold us harmless from any claims related to them.

Third-Party Content

The Bot may link to or display content from third-party services (Last.fm, Spotify, Discogs, etc.). We do not control or endorse third-party content and are not responsible for its accuracy, privacy practices, or policies. You access third-party services at your own risk.

Bot Management

We reserve the right to:

  1. Monitor the Bot for violations of these Terms
  2. Take action against users who violate these Terms or the law
  3. Restrict or disable access to any features at our discretion
  4. Remove content that is excessive or burdensome to our systems
  5. Manage the Bot to protect its proper functioning

Privacy Policy

We take data privacy seriously. Please review our Privacy Policy, which is incorporated into these Terms.

The Bot is hosted in Finland. If you access the Bot from outside Finland, you consent to your data being transferred to and processed in Finland.

We do not knowingly collect information from children under 13. If we learn that a child under 13 has provided personal information, we will delete it promptly.

Termination

These Terms remain in effect while you use the Bot. We reserve the right to deny access to the Bot to any person, for any reason, without notice. If your access is terminated, you may not create a new account to circumvent the termination.

Modifications and Interruptions

We may change, modify, or discontinue any part of the Bot at any time without notice. We are not liable for any downtime, interruptions, or changes to the Bot. We do not guarantee the Bot will be available at all times.

Governing Law

These Terms are governed by the laws of the Netherlands. If you are an EU consumer, you also benefit from the protections of your country of residence. Both parties submit to the non-exclusive jurisdiction of the courts of the Netherlands.

Corrections

We reserve the right to correct any errors, inaccuracies, or omissions in the Bot at any time without prior notice.

Disclaimer

THE BOT IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT RESPONSIBLE FOR ERRORS, INTERRUPTIONS, UNAUTHORIZED ACCESS, OR ANY DAMAGE ARISING FROM YOUR USE OF THE BOT.

Limitations of Liability

WE ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE BOT. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU HAVE PAID US, IF ANY.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from: (1) your use of the Bot; (2) your breach of these Terms; (3) your violation of any third party's rights; or (4) any harmful act toward other users.

User Data

We maintain data you transmit to the Bot for operational purposes. While we perform regular backups, you are responsible for your own data. We are not liable for any loss or corruption of data.

Electronic Communications

By using the Bot and our website, you consent to receive electronic communications from us. You agree that electronic communications satisfy any legal requirement for written communication.

Miscellaneous

These Terms constitute the entire agreement between you and us. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision does not waive that right. No joint venture, partnership, or employment relationship is created by these Terms.
