After downloading the game I tried to change the appearance of the deck and background. While it says that the new appearance will take effect with a new game the new background changes immediately while the deck changes properly with the new game. I'm not sure if it was deliberate but I think not.

It is as it was meant to be. It states on the Change Appearance window that deck changes (meaning the card backs) will take effect on a new game, but it allows for immediate background changes. So, this isn't a bug, since it displays a proper note and performs the task in alignment with said note.
