If the patent is sufficiently small in cost, then companies who use Linux will pay the patent and use code that implements it. Android, GCP, Azure, AWS, etc will continue to flourish. Competing Linux kernels - RHEL, SuSE, the one you download - will languish.

Given their track record opposing efforts to hold VMware and other alleged GPL violators to account, I imagine the Linux Foundation will quickly endorse this idea.
