It's a grossly unfair comparison. Everyone knows that getting code pushed upstream is a long-term effort. Even in the best of circumstances it can take months, and when there are important kernel developers who are skeptical of the code it can take years. Writing a tool to watermark code by making non-critical changes is the kind of thing that could be whipped up in a day or two by anyone who cared to try. Tracking who got which watermarked version of the code would be a little more effort on top of that, but nothing drastic.
