Sounds like you are saying that better tools for analysing binaries for violations of various sorts might be the path to more software freedom.

IMHO, manufacturers are not wise enough to realize that their use of confidentiality is ill oriented from a global point of view. But their are certainly smart enough to engage in an easy asymetric race with those trying to analyze their software: they are sure to win (ideas like documentation retention, in the field encryption, legal retorsion, etc. pop up in seconds - in fact, they are already done).
