At the close of the current session of the Supreme Court, the Justices have handed down a mixed bag of rulings that span a surprisingly diverse range of political opinion. Some will be celebrated by Republicans who share the conservative views of the Court’s majority, while others will provoke Donald Trump to throw childish tantrums, and perhaps portions of his lunch at the Oval Office walls.

Among the decisions that Democrats will appreciate are the one that upheld mail-in voting, which Trump delusionally regards as fraught with fraud; the one that let stand the $5 million defamation judgment against him by E. Jean Carroll, who Trump was found to have sexually abused; and the one that prohibited the president from firing Federal Reserve Commissioners without cause.
Conversely, Trump will applaud the Court’s rulings on allowing discrimination against transgender athletes, and the one that permits campaign corruption via unlimited donations and spending by political parties. Which is part of his mission to undermine democracy.

Perhaps the most galling decision from Trump’s point of view is the case wherein the Court upheld the Constitution’s grant of birthright citizenship. It ought to have been an easy decision since the 14th Amendment begins “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” And yet three Justices (Samuel Alito, Clarence Thomas, and Neil Gorsuch) voted to end the practice.
True to form, Trump was appalled. Shortly after the ruling was made public he posted comments on his failing Twitter ripoff, Truth Social, expressing his outrage, as well as his intention to ignore and defy the Court. He raged that…
“The Supreme Court upheld Birthright Citizenship, which is too bad for our Country, but we can easily make it up in Congress through Legislation, with the support of the President, that has now been determined during this process. No long and unwieldy Constitutional Amendment is necessary! Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!”
No one will be surprised by Trump’s defiance or his intention to recruit Congress for his criminal mission to undermine the law. However, Trump’s claim that “we can easily make it up in Congress through Legislation,” is wholly without legal justification.
Trump is latching onto a portion of Justice Brett Kavanaugh’s bizarre concurrence wherein he claimed that the only reason that Trump’s executive order revoking birthright citizenship was wrong was because it violated a federal law. Which is a little rotten Easter egg that Kavanaugh laid in order to give Trump a legal lifeline. But Kavanaugh must have missed the part of the 14th Amendment that said that legislation by Congress can only be used to “enforce the provisions” of the Amendment. Not to redefine them.
Trump’s assault on the ruling and the Justices continued in a subsequent comment where he sarcastically wrote that “I would like to congratulate President Xi, and the Great Country of China, on their massive Birthright Citizenship WIN!” But that was hardly the worst of his commentaries on this subject. In recent weeks he has been posting comments that illustrated his opposition to the Constitution. For instance…
- April 1: “We are the only Country in the World STUPID enough to allow ‘Birthright’ Citizenship!” Which is false. More 30 countries have birthright citizenship.
- May 24: “Birthright Citizenship is suicide for our Country!” Which is Trump’s repost of a comment by Mark Levin Of Fox News.
- June 11: “The United States of America cannot live with the shackles of Birthright Citizenship.” Never mind that the nation has lived – and thrived – with it for 158 years.
We can expect more of this sort of madness from Trump going forward. He doesn’t care that he was firmly smacked down by the Court. Nor does he care about the welfare of the Americans whose citizenship he is trying to revoke. He only cares about advancing his prejudices and the bigotry of the MAGA cult that he leads. But he is going to learn the hard way that America does not share his hatred. Well, scratch that. He never really learns anything.
