  • On December 5, 2025, the Office of Environmental Health Hazard Assessment (OEHHA) added two chemicals to the Proposition 65 List: 1. Bisphenol S (BPS) - added the developmental toxicity endpoint to the reproductive toxicity listing of bisphenol S (BPS) under Proposition 65 • This addition was done via the “State’s Qualified Experts” listing mechanism, based on the Developmental and Reproductive Toxicant Identification Committee’s (DARTIC) determination that this chemical was clearly shown to cause developmental toxicity. The warning requirement for significant exposures to BPS took effect on December 29, 2024. 2. N-Methyl-N-Formylhydrazine – added to the Proposition 65 list as a carcinogen • The warning requirement for significant exposures to N-methyl-N-formylhydrazine will take effect on December 8, 2026.   • Effective January 3, 2025, the Office of Environmental Health Hazard Assessment (OEHHA) added vinyl acetate to the Proposition 65 list as a carcinogen with an effective date of January 3, 2026. Additionally, on December 23, 2025, OEHHA issued an information letter addressing potential consumer product exposures to vinyl acetate. Vinyl acetate is mainly used in the production of polymers and copolymers, for instance polyvinyl acetate (PVA), polyvinyl alcohol, polyvinyl acetals, ethylene-vinyl acetate (EVA) copolymers, polyvinyl chloride-acetate copolymers, and vinyl acetate-vinyl laurate copolymers. Businesses assessing vinyl acetate exposure should note that only vinyl acetate (CAS 108-05-4) is on the Proposition 65 list, not its polymers and copolymers. Residual monomer may exist in products, but the presence of polymers and copolymers alone isn’t sufficient evidence. Testing should measure actual release during foreseeable use, not dissolution under unrealistic conditions.   • On December 12, 2025, the U.S. Consumer Product Safety Commission (CPSC) approved a direct final rule for bassinets and cradles under section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA). This direct final rule updates 16 CFR part 1218 to incorporate by reference the revised voluntary standard, ASTM F2194-25. ASTM F2194-25 includes several additions and revisions, including new definitions, new performance requirements and test methods, clarifications to existing requirements, as well as editorial revisions that do not alter substantive requirements in the standard or impact safety. The rule is effective on February 21, 2026, unless the Commission receives a significant adverse comment by January 12, 2026.
