Mattel didn’t steal the idea for reality competition show The Toy Box from a producer, who accused the company of ripping off his concept for an identical series that he pitched, a jury has found.
The decision comes after a 10-week trial in Santa Monica that touched on standards for protectable ideas and when a company can be on the hook for moving forward with a concept independently pitched by multiple producers. In a verdict that could discourage other creators from suing over idea theft, a 12-person jury on Thursday rejected Norton Herrick’s bid for more than $46 million in lost profits he sought to claw back from Mattel.
Back in 2014, Herrick said he pitched the idea for Playmakers, an unscripted show featuring inventors who pitch their toys to child judges, with the goal of reaching the finale. The winner receives a cash prize and a contract with Mattel...

After a high-stakes trial, a jury has found that Mattel did not steal a reality show concept from producer Norton Herrick, marking a major victory for the toy giant, which could have been on the hook for $46.2 million in damages.
The verdict follows a 2½-month civil trial in Santa Monica that pitted the “Lone Survivor” producer against the company whose intellectual property spawned the Hollywood blockbuster “Barbie.” In a crushing blow, the 12-member jury shot down Herrick’s claims of breach of an implied contract, breach of confidence, fraud-misrepresentation, fraud-concealment and misappropriation of trade secrets.
Herrick initially sued Mattel in 2018, claiming that the company stole his idea for Mattel’s reality competition show “The Toy Box,” which ran on ABC for two seasons beginning in 2017. Back in 2014, Herrick brought a similar competition show to Mattel executives dubbed “Playmakers,” which revolved around contestants pitching their toys to child judges and winning prize money.

For the past 10 weeks, a Hollywood producer has faced off against a studio in a Santa Monica courtroom stemming from a civil case that has caused barely a news ripple.
Back in January 2018, “Lone Survivor” producer Norton Herrick sued toy giant Mattel over a 2018 contract dispute regarding the production of Mattel’s reality competition show “The Toy Box,” which ran on ABC for two seasons.
In his initial complaint, Herrick claimed he brought a project to Mattel in June 2014 called “Playmakers,” which revolved around contestants pitching their toys to child judges and winning prize money. According to the suit, Mattel executives loved the idea and indicated they were moving forward with it only to pursue a replica without his involvement. The “Barbie” producer ultimately produced a similar version of the concept in 2017 with “The Toy Box.”
The case has garnered almost no press coverage over the ensuing six-plus years, perhaps...

In 2021, ESPN broadcaster Sage Steele was suspended following comments she made on a podcast, including calling parent company Disney’s vaccine mandates “sick” and questioning why Barack Obama considers himself Black when he was raised by his white mother. When she returned to her job, she felt she’d been sidelined from key on-air opportunities. So she dialed one of her closest friends, Chris Harrison, for advice. They’d gotten to know each other while co-hosting the Miss America pageant and the Scripps National Spelling Bee. He, too, had recently lost a big gig — as host of ABC’s The Bachelor, after defending a contestant accused of racism.
“Chris said, ‘I know who you need to talk to — my lawyer. He’ll be calling you momentarily,’ ” Steele remembers. “Within five minutes, Bryan Freedman was on the phone with me.” Steele left ESPN — she now has a podcast at Bill Maher...

Exclusive: Fox is building on its success in Lego with a new knock-em-down competition series featuring dominos.
The network has ordered Domino Masters from its own nascent production studio Fox Alternative Entertainment. The series will premiere in the 2021-22 season.
Domino Masters feature teams of domino enthusiasts facing off in a domino toppling and chain reaction tournament. Throughout the competition, Modern Family star Stonestreet, alongside the judges, will encourage the domino aficionados, introduce challenges and put the creations to the test until one team is crowned the Domino Master.
Think of it like a series of Rube Goldberg machines with chain reaction happening all over set.
It is Stonestreet’s latest non-scripted entertainment series. The Emmy-winning actor previously hosted ABC’s The Toy Box and appeared as a guest judge on NBC’s America’s Got Talent.

Propagate, run by Ben Silverman and Howard Owen, has acquired Electus, as well as a majority interest in powerhouse talent management and production firm Artists First from Barry Diller’s Iac.
The independent content creation and distribution company is looking to expand its full-service global studio. The deal combines Electus’ popular content, international sales division and valuable library and Artists First’s impressive talent roster and hit shows with Propagate’s already robust content creation capabilities and strategic relationships. Terms of the deal were not disclosed.
“At Propagate, we are focused on building premium content with the best creative voices from around the world, and being able to support the growth of Electus and all of its partnerships is incredibly exciting to us,” Silverman and Owens said in a joint statement. “We have had the privilege of working closely with Peter Principato and his team of world-class executives and managers...

Updated: Two and a half years after Ben Silverman left the company he had founded, the Iac-owned Electus, to join Howard T. Owens in A+E Networks-backed Propagate, the duo have acquired Electus and its majority stake in management/production company Artists First from Barry Diller’s Iac.
Terms of the deal were not disclosed though I hear it is worth under $50 million. I hear Diller recently put Electus-Artists First up for sale and other main buyers who bid for the assets included Entertainment One.
The acquisitions were financed through the investment secured earlier this year from The Raine Group to accelerate Propagate’s global growth through new ventures and targeted acquisitions. Original investor A+E Networks also owns a stake in Propagate.

Propagate, the production banner headed by Howard Owens and Ben Silverman, is in expansion mode with a deal to acquire Electus and a majority interest in management-production banner Artists First.
The deal reunites Silverman with Electus, the company he founded a decade ago with backing from Barry Diller’s Iac. Electus had been quietly shopping for a buyer for the past few months after Iac came to the conclusion that the company largely focused on unscripted programming was not a fit with the rest of its digital-centric operations.
Electus is the producer and distributor of series including NBC’s “Running Wild with Bear Grylls,” ABC’s “The Toy Box,” the CW’s “Jane the Virgin,” and Discovery’s “Darkness,” along with production companies Big Breakfast (“Adam Ruins Everything”) and Notional, producer of Food Network’s “Chopped” franchise. The price tag for Electus was said to be around $35 million, according to a knowledgeable source.

The 2017-18 television season is in the books, and as usual, some shows performed better than others. Like, better than all of these.
Broadcast’s lowest-rated entertainment series this time around was CBS Saturday show “Ransom,” which our readers have probably never heard of. ABC’s reality competition “The Toy Box” was just one-tenth of a ratings point behind that one among adults 18-49, which is the demographic most-beloved by advertisers.
See how the 12 lowest-rated broadcast TV shows rank by their ratings below. For purposes of this story, we elected not to count shows on The CW, which would have gobbled up a bunch of spots. See the full rankings below.

ABC’s “The Toy Box” will (mercifully) come to an end next week, when it may actually go out on a high note — that is, if last night’s momentum is any indication. The “Shark Tank”-for-kids show actually grew in Nielsen ratings this past Sunday with its penultimate episode, hitting a season high. Unfortunately, the season high for this series still isn’t anything one would call “good,” and ABC still finished fourth among the Big 4 broadcasters. NBC and Fox were the dominant forces last night, thanks to primetime and late-afternoon NFL football, respectively. Due to the nature of live sports,...

ABC might want to throw “The Toy Box” back in the closet. “Ten Days in the Valley” didn’t do much better. The Disney-owned broadcaster finished a pretty distant fourth place among the Big 4 networks, though thanks to “Shark Tank,” ABC was able to stay out of the basement in terms of total viewers. That unfortunate distinction went to Fox. NBC dominated another Sunday night due to its primetime NFL football, which had the usual pregame lead-in.
