Discovery and their respective counsels said today that they had agreed to a voluntary dismissal of a lawsuit lodged last month that had an upcoming HBO Harry Potter series in the middle. Matt Reeves' The Batman Universe show The Penguin and the Dune Universe's Dune: Prophecy will no longer premiere as Max Originals. Both shows will now debut as HBO Originals, joining Harry Potter, Lanterns, and the It prequel Welcome to Derry, which all made a similar shift last month.
Per Deadline, the shift is part of Warner Bros. Discovery's strategy to rebrand its highest-profile titles into HBO Originals, giving them a linear airing on the premium cable network and a streaming launch. Before The Penguin and Dune: Prophecy decision, the company revealed in June that it was not sure both shows would fall under the rebranding. The Penguin, starring Colin Farrell as the eponymous character, was developed by Lauren LeFranc and produced by Reeves' 6th & Idaho Productions and Dylan Clark Productions in association with Warner Bros. Television and DC Studios. The show's events occur shortly after those of The Batman.

The Harry Potter TV series is moving forward, with Warner Bros. Discovery now targeting a 2026 debut for the high-profile project.
The date was revealed Friday morning by David Zaslav on the company’s fourth-quarter earnings call.
“We’ve not been shy about our excitement around Harry Potter,” he said, discussing Wbd’s franchise strategy. “The last film was made more than a dozen years ago.”

The Harry Potter television series is closer to naming its creative leader as Deadline understands that the shortlist is now down to three names.
We hear that Succession writer Francesca Gardiner is now among the finalists to score the job of adapting Jk Rowling’s books for the Max streaming platform. It’s understood that Gardiner is now one of three writers currently being considered to lead Harry and his pals on the small screen.
A decision is expected soon. Max and Warner Bros. Television declined to comment.
