Arrested along with Khristine Eroshevich, and Sandeep Kapoor in March 2009, and charged by then-California Attorney General Jerry Brown of illegally furnishing medications to Anna Nicole Smith. In October 2010, a jury acquitted Kapoor, but found Stern and Eroshevich guilty of two counts of felony conspiracy. The charges against Stern and Eroshevich were dismissed in January 2011.

Anna Nicole Smith listed Stern as the father on her daughter Dannielynn's birth certificate. After Smith's death Stern fought for the custody of Dannielynn with Smith's mother and celebrity photographer Larry Birkhead who claimed he was the biological father. A paternity test proved that Larry was Dannielynn's father and he was awarded custody of the girl. Virgie launched an appeal to gain custody of her granddaughter but the custody order was upheld and Larry was allowed to leave the Bahamas with his daughter.
