Marston was replaced on "One Life to Live" in 2007 after he was arrested on assault charges following a street fight in New York City at 45th St. and 10th Ave. He left the show shortly after his arrest. Marston, a 6-foot-3 former amateur boxer, "appeared to be crazed on cocaine" at the time of the attack "The Daily News" newspaper reported. He allegedly screamed, "I'm going to get you!", attacked three men with a metal crate and kicked at police officers during the scuffle. When cops arrived, Marston allegedly began flailing his arms and kicking the officers who later took him to Bellevue Hospital where he was classified as an emotionally disturbed person. The fight left an officer bruised and one man with a broken leg. Marston initially was charged with four counts of second degree assault, menacing, reckless endangerment and resisting arrest. In March 2010, Marston pleaded guilty to a misdemeanor charge admitting to resisting arrest. A plea deal had Marston not sentenced to jail, but to complete an anger-management program.
