- Richard was asked to return for "Survivor: Heroes vs. Villains"; However, in order to play, he had to apply to leave the U.S. Due to still being under house arrest his request was denied by a federal judge in Rhode Island.
- On September 8, 2005, a federal grand jury in Providence, Rhode Island, indicted Richard Hatch on two counts of tax evasion. Hatch was offered a lenient sentence in exchange for a guilty plea, which he declined due to his belief in his innocence. Richard went on to state that he was basing his legal defense on an alleged agreement that NBC and Survivor producers would pay the taxes on the winnings prior to giving him the money if Hatch won if he swore to not disclose production staff feeding another contestant secretly, interfering with the authenticity and legitimacy of the reality game. The Judge presiding over the case refused to allow discussion of this and on January 25, 2006, found Mr. Hatch guilty of tax evasion for not paying the taxes owed.
